U.S. Senate Votes to Uphold Second Amendment in Washington, D.C

U.S. Senate Votes to Uphold Second Amendment in Washington, D.C.

Thursday, February 26, 2009 Fairfax, Va. - The United States Senate has voted, with overwhelming bipartisan support, to adopt an amendment offered by Senator John Ensign (R-NV) that seeks to protect the Second Amendment rights of law-abiding citizens in the District of Columbia. The amendment, attached to S.160, the D.C. Voting Rights Act, will repeal restrictive gun control laws passed by the District of Columbia's (D.C.) city council after the landmark D.C. v. Heller Supreme Court decision. The vote margin was 62-36.

"Today's vote brings us one step closer to restoring the Second Amendment freedom of law-abiding D.C. residents," said NRA-ILA Executive Director Chris W. Cox. "It's ludicrous that good people in our nation's capital continue to be harassed as they try to defend themselves and their loved ones in their own homes. This vote reinforces the historic Heller ruling."

After the Heller ruling, the D.C. city council passed a law requiring would-be gun owners to pay a registration fee, pass a 20-question multiple choice test, take a five-hour training course, undergo an invasive background check every six years, re-register any firearm every three years, and finally, submit all handguns for ballistics testing. Current D.C. law also bans an overwhelming majority of firearms commonly used for self-defense. This Ensign Amendment would also remedy that unjust practice.

"NRA would like to thank the lead sponsor, Sen. John Ensign for his efforts to reform D.C.'s gun laws and enable folks to protect their property and their loved ones," concluded Cox. "It's time for leaders in Washington to wake up to the fact that the Supreme Court decision is now the law of the land."

But the Supes just affirmed the Lautenberg theft of rights.

Until the people revolt and re-write the constitution in absolutely unambiguous terms, there really are no rights.

I know. I was referring to the “DC vote” being unconstitutional and Pelosi stripping the gun rights provision. Sorry if I wasn’t clear.

They’re not going to tackle gun issues when they’re spending like drunken sailors. Give it a year or two, when they think we’re complacent and they’ll be grabbing our guns.

I’d be interested in a breakdown of the vote. I’d imagine anyone voting for this would oppose an “assault weapons” ban.

“Who are the militia? Are they not ourselves? It is feared, then, that we shall turn our arms each man against his own bosom. Congress have no power to disarm the militia. Their swords, and every other terrible implement of the soldier, are the birthright of an American. ...[T]he unlimited power of the sword is not in the hands of either the federal or state governments, but, where I trust in God it will ever remain, in the hands of the people.”
—A Pennsylvanian, The Pennsylvania Gazette, 20 February 1788

Everyone who is eligible should buy a gun and learn how to use it. Those who already own a gun should buy another one, or more. This will send a clear message to the Socialists (Democrats), RHINOs, terrorists, and other crooks. The right of the people to keep and bear arms shall not be infringed.

BUT....some experts say this is just cheap political posturing that will be stripped from the final bill - that it is nothing but a fig leaf for liberals.

I really doubt it. I think there is desire but no staying power.

Nancy may detect a big loss but BO will have so much destruction done by then a loss won’t matter.

My 2 Texas Senators voted the right way; the two assclowns from NJ, my former state, naturally voted to keep the citizens of DC serfs. Glad to be out of that schithole.

Glad to see that Sheets voted with us.

I think that this vote may, along with Pelosi’s statement, lead to the mature Dems saying “its just not worth it” regarding the AWB. Hopefully they realize that it is the 3rd rail. Of course, O and his crew of nutjobs think differently, and we may get the thing anyway. But I’m at least a bit encouraged by this vote, for whatever it is worth.
