Handgun's Color Leads to Lawsuit (Alan Gura from D.C. v. Heller strikes again!)

A D.C. woman filed suit in U.S. District Court yesterday, claiming that the city would not let her register a pistol because of its color.

Tracey A. Hanson argued that her application to register a .45-caliber semiautomatic was denied because the gun is not on the California Safe Handgun Roster, which is the standard in the city.

Hanson tried to register a two-tone, stainless steel/black pistol, according to the suit. But the list has that model in olive drab green, dark earth or black, not in two-tone, stainless/black, the suit asserts...

If the California list turns out to be illegal in DC, it’s going to be illegal in California as well. Massachusetts has a similar list, I believe, even more restrictive.

After their ban was struck down, DC declared any gun with a magazine (ie all pistols) to be “machine guns” and thus banned. That left only revolvers.

They realized that would just be struck down as well, so they looked for the next most restrictive thing. That turned out to be California’s list of approved pistols. They decided to ban any pistol model after 1985 or so, and allow only models that had been “safety tested” (ie, charge the manufacturer a ton of money and make them jump through bureaucratic hoops forever and ever, despite the fact that those pistols work just fine in the other 49 states).

In this case, it’s a gun that *was* in production before the cutoff, which CA begrudgingly grandfathered in despite not having the required dumbing-down features to make it “safe enough”. When the company released the gun in a new finish, CA refused to allow this exact same gun.

So DC is banning a differently colored version of a gun that CA bans because it was produced after CA froze handgun “safety” certification despite allowing an identical model.

Several years ago I was looking at a .357 snubbie. It came in either titanium or blue steel. The blued model, even though the same gun, had not been tested for the roster, so i bought the titanium gun when I would rather have had the steel gun. CA is pretty screwed up.

Honestly, WHY don’t we have a tax code that fits, in human readable form, on a single dueplexed page?
WHY do we tolerate all these onerous regulations and rules, even when they are contra-constitutional?

At the risk of taking the shine off my previous post, I will nevertheless spell it out to the DUers, fencesitters, neutrals, and antis: The DC government is nothing more than bigoted about guns. There is NO other precedent where skin-deep color determines legal status, other than the racist laws of the past. This is the legacy that the gun prohibitionists there wish to carry. It was despicable then, and it is despicable now. Consider all the talk of “diversity” and try to fit that in with DC’s ruling.
