On-Line Shopping E-Tax Is Un-Constitutional

Many states are looking for ways to increase their tax revenue by taxing purchases made online. This extends to third party solicitors located in another state. Our Constitution infers that states are restricted from enacting laws that burden or restrict interstate commerce. Let’s stop this tax now.

When I did my taxes with TaxCut, there was a screen that asked me questions about whether or not I bought stuff in another state(s) or online that I needed to declare and pay taxes on.

it’s called use tax folks, it’s constitutional, I worked at revenue for 5 yrs

Maybe disabilities act? Reasoning - those who can’t get out to shop can buy online but have to pay POSTAGE. If they have to pay tax plus postage they are being unduly burdened. I’ve heard more ridiculous things.

This also burdens those who live far away from population centers and shopping sources.

Horseshit. No state can force a person/corporation to collect sales tax for a state in which they have no presence.

The use tax is constitutional, the means of enforcing its collection may be not.

If a state asks for a company/person in an other state, (that has no presence in their state), to collect tax for them, it is most definitely unconstitutional.

If hunters take a holiday and don’t go hunting and don’t buy deer tags etc. it will wreck a lot of states’ budgets.
