Voters disagree with Supreme Court nominee Sonia Sotomayor's controversial ruling in the New Haven firefighters' reverse-discrimination case by more than three-to-one, a new poll shows.
Voters also strongly oppose using affirmative action programs to increase diversity, according to the Quinnipiac University poll released Wednesday morning.
"If you look at the data," Quinnipiac Assistant Director Peter Brown tells Newsmax, "what's most interesting is how large their objection is for diversity being a reason for affirmative action. The numbers are staggeringly negative."
In an unusual survey of 3,100 voters -- most national polls rely on about 1,200 respondents – voters by 71 to 19 percent think Sotomayor was wrong to permit New Haven to throw out the results of a promotional exam for firefighters, simply because no African-Americans scored well enough to qualify for promotion.
Asked if Sotomayor's ruling, which has been appealed to the Supreme Court and may be overturned, would make them less likely to support Sotomayor's confirmation, 28 percent said they would be less likely to support her. Fifty-nine percent said her ruling would make no difference in terms of their support.
The results indicate Sotomayor and President Obama could be seriously out of step with voters on the importance of hiring decisions blind to a person's race or personal background, especially in the midst of a serious economic downturn when workers are competing for jobs.
By a 59 to 27 percent margin, even Democrats thought New Haven was wrong to disregard the results of the exam.
"It is obviously an area that those trying to block her confirmation may be able to exploit politically," says Brown. "There is clearly strong opposition from white voters about these programs."

Unfortunately, the GOP politicians lack the courage to stand for something that matters. They need to make their case, and I'm counting on them to do it. It's not enough to ask a few token questions and hope the media will report fairly and the people will get it. They need to drill every point home, justify their positions clearly, point out that obama could have found a number of hispanics who were also qualified for the job (Estrada and Alberto Gonzales come to mind), and then vote against Sonia Sotomayor because she is a racist.

Not that it matters, the Court makes policy, just ask Sotomayor.
The GOP must learn to frame the argument from the majority of the US which is white America. Don’t name call and call her a racist. That is stupid. Simply say every day in America, if a white man made a similar remark, even in jest or out of ignorance would immediately be fired. He would not be givened a chance to explain or restate his remarks. The best he can get is one chance to apologize and if the offended minority says it is not good enough, he is fired. If the Dems say that is an exaggeration, just remind them what happened to Imus. If the opposition to the appointment is framed is this simple illustration, many white guys in this country and whites in general can identify with it because in the work place events like this have happened or someone knew of someone who had been fired or demoted for it. MSM cannot stop this sentiment because it exists at the street level, a level many GOP politicians are out of touch with.
Too bad, the American people voted for her henchman, and nothing will prevent her from taking that seat on October 1. The American people are incapable of serious reasoning.

Puerto Rican Nationalist Nominated to North American Supreme Court [Ed Whelan]
First, I’m curious as to when Sotomayor ceased being a Puerto Rican nationalist who favors independence — as she says she does in the preface. (The position, as she points out in the thesis, had received 0.6 percent in a 1967 referendum, the most recent such vote before she wrote the thesis.) I don’t know that I’ve seen it reported anywhere that she favored Puerto Rican independence, which has always been very much a fringe position. . . .
Second, her unwillingness to call the Congress the U.S. Congress is bizarre — in the thesis, it’s always referred to as either the ‘North American Congress’ or the ‘mainland Congress.’ I guess by the language of her thesis, it should be said that she’s seeking an appointment to the North American Supreme Court, subject to advice and consent of the North American Senate. This kind of rhetoric was very trendy, and not uncommon, among the Latin Americanist fringe of the academy.

Isn’t the US a republic so that it is not subject to the whim of public opinion on a daily basis? I would think that if the founding fathers wanted the Supremes chosen by the people they would have had them elected by the people. This whole thing cuts both ways and when/if conservatives ever get back into power, I want to have been consistent. Only agreeing to the rules that benefit your team at a given time is Liberal bread and butter. I have seen to much of it lately at FR as far as I am concerned.
I don’t like Soto at all. But the Rats won and they get to chose her. She will be confirmed and there isn’t really that much that can be done about it.
