Alleged Robbers in U.S. Illegally (Killed Denny's Employee)

Three men who allegedly stormed into a West Side Denny's over the weekend and killed a 34-year-old cook were in the United States illegally, and one had been deported less than a year ago after an arrest. Pablo Ortiz, who police say is a member of the notorious Salvadoran gang MS-13, was arrested in Albuquerque in May 2008 on suspicion of DWI. After a judge found him guilty, Ortiz spent 46 days at the Metropolitan Detention Center. He was released on July 7.

Immigration and Customs Enforcement agents "put him on a plane and sent him back to El Salvador" in August of 2008, the chief said. "Some time in the next few months, he sneaked back into the country." Federal officials also confirmed that two other suspects in the Denny's shooting are here illegally, but it is unclear whether 22-year-old Marvin Lopez-Aguilar and 25-year-old Francisco Melgar had previously been deported to El Salvador.

Schultz said in the case of Ortiz's May 2008 arrest, the officer who pulled him over did not contact federal authorities because the officer did not believe his immigration status was pertinent to the DWI investigation.

The current policy reads: "Officers shall not inquire about or seek proof of a person's immigration status, unless the person is in custody or is a suspect in a criminal investigation for a nonimmigration criminal violation and the immigration status of the person or suspect is pertinent to the criminal investigation."

It is a great place to live but for the crime. Also, it isn’t motorcycle friendly which is not good because I ride too. There are too many crazy drivers. It seems weird to say but it is the truth. I am not the only one who thinks that way.

it is the crime and nobody seems to understand what to do about here.

I used to live in Boise and this would never happen there. Cops shoot to kill there :-)

Small world...my Dad grew up in Boise...been there a few times, but not lately...right about them not taking any bullshit up there, though...I might end up there, the way things are headed...please tell me it’s still one of the last normal places left?

As it stands, a hodgepodge of laws govern whether illegal immigrants can lawfully drive in the United States. Ten states (Hawaii, Illinois, Michigan, Montana, New Mexico, North Carolina, Oregon, Utah, Washington and Wisconsin) do not require license applicants to demonstrate that they are lawfully present in the United States, in effect granting driver's licenses to illegal immigrants. Most of those states do require applicants to present an identification card issued by their home country.

Five other states provide special licenses with distinguishing features for non-citizens. South Dakota is the only state that - without exception -- requires all license applicants to give a Social Security number, which many illegal immigrants do not have. The others accept a patchwork of identification combinations. Some accept a taxpayer identification number issued by the Internal Revenue Service in lieu of a social security number.

New Mexico last year became the latest state to issue driver's licenses to illegal immigrants, and officials say the change has helped contribute to a drop in the state's uninsured rate, which in December of 2002 was 33 percent the highest in the nation and now is 17 percent. Insurance premiums also have dropped in that state and fewer people are fleeing accident scenes, according to Moran of the National Immigration Law Center. Almost 14,000 of the state's estimated 150,000 illegal immigrants have obtained licenses in the past year.

That’s strange. When I went to get my NM DL a few years back, I had to provide two proofs of residence, my DL from my prior state, my BC and SS Card. Oh, wait, I’m the wrong “type.”

I’m serious. People who are affected (like the family of this poor woman) should sue those responsible for allowing illegal aliens to be here in such numbers. I realize they won’t win, but it would bring this issue out *from the shadows*.

Well sure. Next to just buying them cars and chauferring them from crime scene to crime scene, letting them basically have NMDL's on a whim actually does look relatively lenient in comparison.

I was thinking more along the lines of Natural Born Citizen.

Many of our legal, natural born citizens here in NM, who happen to have names that end in "z", are also very much against giving illegals a NM DL. Unfortunately, I think they are now in the minority...

Many?? In my experience from growing up Anglo in Northeren NM, most of the local Hispanos, who I suppose correctly consider themselves the descendents of the Conquistadores, pretty much loathe "Los Pinches Mojados".

I know my sister-in-law's family from Abiquiu certainly does. Try calling them Mexican and you'll have a real fight on your hands. They're "Spanish".

My good buddy from Cordova once told me: "We only let the Mojados come here so the fat chicks can get laid too".

That's been my experience since moving here. Woe be unto he who calls a long-time local a "Mexican." I learned that long ago when I was a kid, and I didn't even grow up in NM.

Of course since our governor is sort of a 'reverse anchor baby' himself, who grew up in Mexico and owes his psychic allegiance to Mexico, rather than the USA, it is no wonder that he embraces illegal immigration.

However, I have no idea what excuse those other nine states have for their policies to legitimize the illegal.

Seriously, I grew up in southern CO where the local Hispanics were mostly descendants of the original Spanish, and very classy and mostly well-off.
