Lots of outrageously outraged e-mails flowing in about this, although it’s interesting to me mainly as a First Amendment curio. The footage comes from Jim Moran’s health-care town hall on Tuesday night. The question: Can a congressman bar signs, or certain types of signs, from an event at which he’s speaking? The answer (and the ambiguity) turns, I assume, on whether the event is “public” or “private.” It’s a public school and Moran is very much a public official, but recall that Claire McCaskill evidently got away with imposing a “no signs” policy at her own town hall where the incident with the Rosa Parks poster happened. That makes me think either there’s some sort of public/private wrinkle to these meetings that we’re missing or that banning signs is valid as a “time, place, or manner” restriction on certain forms of speech. But if that’s so, why does the guard here seem to distinguish between signs with images on them and signs that are text-only? Help me, constitutional scholars and law-school grads, you’re my only hope!

The cop seemed to be saying that other signs being pointed out were OK but the sign the guy was holding was not because it had a picture on it. What???

No...he was not. Unless the city where that townhall was being held can show a statute that forbids signs(picture or not) on school grounds(which is ridiculous..schools have signs for athletics, etc. all the time)..then the school district and the city can be sued.

I find that particular picture of Obama menacing. That said, freedom of speech by the first amendment is at it’s “zenith” when it comes to political speech. That, Wesley, is the Supreme Court’s words. And it still is America.

I wish he'd held it back up and gotten thrown off the property or charged -- he'd own the freaking city and I would litigate that officer in to freaking extinction. The response should have been "Think you have it bad now communist? Make my day."

Somebody needs to freaking educate these morons on how many millions have been killed by this road we're on. How horrible it is and how desperate all those under it have been to get out from under it. We won WWII but not through attrition of human lives like the communists where they would send 100,000 men in to the lines with 20,000 guns, we did it through skill, determination and strength of character. We won't lose this war.
