Judge Land Fines Orly Taitz $20K, File Copy of Order with State Bar of CA
United States District Court (Georgia) ^ | 10/13/2009 | Judge Clay Land

Posted on 10/13/2009 7:45:31 AM PDT by BuckeyeTexan

When a lawyer files complaints and motions without a reasonable basis for believing that they are supported by existing law or a modification or extension of existing law, that lawyer abuses her privilege to practice law. When a lawyer uses the courts as a platform for a political agenda disconnected from any legitimate legal cause of action, that lawyer abuses her privilege to practice law. When a lawyer personally attacks opposing parties and disrespects the integrity of the judiciary, that lawyer abuses her privilege to practice law. When a lawyer recklessly accuses a judge of violating the Judicial Code of Conduct with no supporting evidence beyond her dissatisfaction with the judge’s rulings, that lawyer abuses her privilege to practice law. When a lawyer abuses her privilege to practice law, that lawyer ceases to advance her cause or the ends of justice.

-snip-

Regrettably, the conduct of counsel Orly Taitz has crossed these lines, and Ms. Taitz must be sanctioned for her misconduct. After a full review of the sanctionable conduct, counsel’s conduct leading up to that conduct, and counsel’s response to the Court’s show cause order, the Court finds that a monetary penalty of $20,000.00 shall be imposed upon counsel Orly Taitz as punishment for her misconduct, as a deterrent to prevent future misconduct, and to protect the integrity of the Court. Payment shall be made to the United States, through the Middle District of Georgia Clerk’s Office, within thirty days of today’s Order. If counsel fails to pay the sanction due, the U.S. Attorney will be authorized to commence collection proceedings.

I believe mlo’s point in following this line of thinking was to establish a baseline with whomever it was he started the conversion.

If you can agree that something can be true and actual outside of and apart from your validation of it, then the conversation can continue. If you don’t believe that, then there is nothing to build upon.

At least that’s my understand of where mlo was going with this.

Could someone have filed the DNC presidential nominee form, (the one where Pelosi certifies O as being qualified), with the DoH as a verifying document to O's vital records, thus making it an orginal vital record also? Just askin'.

Good Question.

There are FR threads into the tens of thousands of replies. This one is only so-so, even by eligibility thread standards.

I gave the examples of a thing existing, without proof and that they are realities(Pluto and Africa).

Shouldn’t the next step then be proof of the thing? or does the conversation stop at a thing exists because it exists?

BS. I don't buy into the Donofrio argument that McCain and Obama are not NBCs based on his theories

Donofrio has his own questionable, hysterical moments. I know, I watched it all unfold, as you did.

But, McCain clearly had and still has unresolved questions, as to whether he qualifies as a natural-born citizen. The very existence of SR.511, plus various Senate bills proposing Constitutional Amendment, to define children born abroad of military parents as natural-born citizens, both support such an argument.

That two citizen parents are a requirement for natural-born citizenship is not in dispute for John McCain. But, he was not born of the soil.

That born of the soil is a requirement for natural-born citizenship is not in dispute for Barack Obama. But, he was not born of two citizen parents.

So, Donofrio has had his highly public, nutty moments himself. He's also aligned with Democrats. That does not invalidate all points raised by him, though.

The same observation can be made regarding practically all so-called attorneys who have attained any level of notoriety, in association with lawsuits pertaining to Presidential eligibility.

I’ve read his stuff. SOme of it is great, some of it is not so great, IMO. Overall, I think his approach will be soundly defeated if his case is heard in court. HOWEVER, I do not waste my time and energy denigrating him. He is trying the best way he knows to get rid of the boy marxist. I wish him well. Also, his latching on to the Miss Tickly method of forcing the HI bureaucrats to cough up info on their statements and actions is very useful.

See Leo's latest blog post in which he reports that HI AG claims attorney client privilege regarding the detailed backup behind AG advising Fukino that BO was NBC.

Hey, don;t be sorry, there will be a hearing, whether its on appeal or interlocutory. Count on it.

BTW, this is not only about winning , it is about making as much public noise as possible. The opposition to Orly has fallen right into the place where that is sure to happen.

I love her strategy, it is grounded on priciples of Satyagraha.

Watch what happens next!

As far as I know, the stated objective of the whole “Miss Tickley” thing is to lay the entire birth certificate matter to rest, by demonstrating it genuine. Donofrio thinks it’s a distraction from the real issue here, which is a foreign father.

It’s also yet another blog, with daily, breathless announcements of routine, daily interactions. Ooooh, “Miss Tickley” is down to the county courthouse again today, and she’s going to reveal yet another heretofore unremarkable aspect of Hawaiian law ... tomorrow. So stay tuned. Exciting, isn’t it.

Milking those hits for AdSense dollars, is what they’re doing.

Miss Tickly has been at this a long time. ANd it is Donofrio, not Tickly, who thinks the records will show Obama to be an NBC.

Well, no. The "Miss Tickly" individual, "TerriK" or under whatever online alias, is in the employ of Donofrio.

And, Donofrio believes birth documentation will ultimately prove Obama to have been born in Hawaii. But, he certainly does not believe that to mean Obama is a natural-born citizen.

understand it. I just don’t agree with it, nor believe some bureaucrat with an MD, (who reportedly took mulitple trys to get her license) is qualified to state it authoritatively. She didn’t say what the requirement that could be verified by the “birth record”, other than birth in Hawaii, alone that would prove someone was an NBC. At minimum it would take records or knowledge of the parents’ citizenship at the time of the birth and that is not even on the long form from 1961 in Hawaii. Birthplace is though, that would give a clue, but would require further documentation, such as naturalization papers from before the birth. If the COLB is correct in every respect, which I highly doubt, his father was still not a US citizen, ever, but that would need to be checked via Visa records, or just be stipulated by all parties that BHO Sr, the presumed father, was not a citizen or even permanent legal resident, at the time of BHO II’s birth, or ever.

I don’t think you need an MD degree to look at a document and read what it says.
Dr. Fukino is an appointee of and serves at the pleasure of Governor Linda Lingle, a Republican who endorsed John McCain for President and spoke at the Republican National Convention in St. Paul. The Attorney General of Hawaii, Mark Bennett is also a Republican and Attorney General Bennett could seek a subpoena for Barack Hussein Obama II’s original birth documents at any time under Hawaii laws. The Attorney General has not chosen to seek such a subpoena.
The primary information that is required to establish natural born American status is birth within the territory of the United States. Barack Obama was born at 7:24 pm on Friday, August 4, 1961 in Honolulu, Hawaii.
There is NO legal precedent for the birthplace of one’s father being determinative of US natural born status if the other parent is an American citizen. In fact, the issue of natural born American status with regard to eligibility to be president has never been adjudicated in any court of law and the Constitution itself is mute on the issue.
Thus far Justices Souter, Kennedy, Scalia and Roberts have all rejected hearing any eligibility lawsuit before the Supreme Court.
