When Sarah Palin's big-bucks memoir "Going Rogue: An American Life by Sarah Palin" comes out Nov. 17, there'll be another book about her hitting the stores the same day: "Going Rouge: Sarah Palin, an American Nightmare."
The "Rouge" book, with a similar name and cover, will be put out by a new company, OR Books, says Publisher's Marketplace, which says it will be composed of "essays assembled by Nation editors Richard Kim and Betsy Reed." Marketplace adds that "it promises 'progressive perspectives on Sarah Palin's political career' by writers including Naomi Klein, Jane Mayer, Katha Pollitt, Jim Hightower, Christopher Hayes, Gloria Steinem, Joe Conason, and Tom Frank."
Shouldn't there be a copyright trademark problem in this somewhere? Publishers Marketplace wondered, too:
... we asked Ned Himmelrich, head of the intellectual property department at law firm Gordon Feinblatt, for an assessment of whether the cheeky new cover crosses legal lines. "Although the first instinct is to believe that the 'Nightmare' book has to be infringing" the publishers "may have found a seam in Palin's protection."

So I guess the presales don’t count as sales then? The publisher needs to put the book out TOMORROW, even if in a limited supply in order to establish the first use...at least that is how it sounds.

The "first use" argument of the lawyer is lost on me. If she had not used the cover first, the Nation idiots would not have been able to copy it.

Palin will sell her own book. And then she will sell theirs too. There's some sweet irony in that.
You are right. The left is deathly afraid of Sarah Palin. She is the biggest threat against Obama. Not Newt Gingrich, Tim Pawlenty, Jeb Bush, Mike Huckabee, or Mitt Romney, but Sarah Palin. If she meant nothing to the left then they would leave her alone.
She scares them for so many reasons. She exites women, brings out true conservatives, excites the Republicans who didn’t like candidates like McCain or Huckabbe or Guliani, and she is not afraid to take on the left and get hammered. She presents the biggest challenger to Obama.
Not surprisingly the only two other people who come close to doing what Palin has done to the conservative base are also women: Liz Cheney and Michele Bachmann.
The only man, so far, as I see it, who has had an effect on the base was Joe Wilson when he yelled you lie! during Obama speech.
The fact is that there is no trademark protection for the title or cover. In any event there has to be a claim of trademark status. That would be the little TM you would see next to an item that is a trademark. When the government actually awards the trademark, then that TM can become the symbol for a registered trademark, which is an R with a circle around it. But in either case, one needs to provide notice that trademark is being asserted. As far as her image is concerned, she’s a public figure, so there’s no inavasion of privacy. However, the photographer would own common-law copyright (assuming he hasn’t assigned it to someone else). Use of the image without permission would be actionable by the holder of the copyright and/or publicatiuon rights to the image. But that’s it.
