Dear Mr. President:

I am the Itancan (chief) of the Oglala Lakota Band of the Great Sioux Nation and Chairman of the Black Hills Sioux Nation Treaty Council, the traditional governing body of the eight bands of the Lakota Nation.

The Lakota Nation entered into and has always abided by the provisions of the Fort Laramie Treaties of 1851 and 1868. However, the United States of America has repeatedly violated and unilaterally attempted to abrogate the Treaties in violation of accepted international standards and codified international treaty law.

The Black Hills Sioux Nation Treaty Council, acting under the guidelines of Article XI of the U.S. Constitution, reaffirms its declaration of inherent authority as a separate and distinct entity from the 1934 Indian Reorganization Act Government of the Bureau of Indian Affairs in the Interior Department of the United States Government. The Black Hills Sioux Nation Treaty Council is committed to upholding the 1851 and 1868 Ft. Laramie Treaties and will employ its' inherent authority to decision making and leadership to protect the integrity of, and our rights in these treaties.

The I.R.A. Government acts as an extension of the United States and carries out its orders.
Your office has sent a mandate to Lakota Bands to initiate a dialogue concerning the Black Hills Land Claim Settlement. How can the United States Government negotiate with I.R.A. Governments, which is an extension of itself?

It is necessary to issue this statement due to current discussions between I.R.A. Tribal Presidents, regarding the United States Governments' Supreme Court action to award monies for the illegal taking of the 1851 and 1868 Ft. Laramie Treaty Territory and other Treaty violations.

We forever oppose the acceptance of any money for our sacred lands.

We recently met with U.S. Senator John Thune's staff to discuss our frustration with the I.R.A. Governments blatant disregard for our inherent authority over treaty issues.

I am 90 years old now. I have spent the better part of my adult life fighting for the return of our sacred He Sapa (Black Hills). I want to create something better for the next seven generations.

IMHO; I don't like the idea of every "band of mission indians" in California and elsewhere having it's own casino(s), under tribal laws, no even on their own land, with which to fleece the "other" neighbors and escape taxes and gaming regulations that even the Mafia has to recognize.

Have a sit down with your local indian sometime - it's big bucks.

Apart from THAT, and probably much of the cause for that, the rest of us have such a lame understanding of the people who got here last before us, that everyone should be embarrased..."red faced" if you insist.

The Sioux and the USG must eventually settle the Black Hills question - I'm sure all the original settlers are sitting on pins and needles waiting for an answer.
Of course, we could just sit on it until the UN decides to step in and set us all straight (they could you know).

And, yes, of course the concept of autonomous regions - or sovereign tribes (not "bands") - sounded good when the tribes and the feds were trying to build a means of dealing with each other but it isn't real comfy to a 21st century national entity that seeks to avoid non-conformity while preaching diversity.

There are a given number of tribes who have codified rights and agreements with the US Government. Right or wrong, these were born in the clash of wills bvetween nations, and they should be honored and administered in good faith by both parties.
(Novel though that concept may be.)

Here in FLorida they’ve built huge casino’s in the middle of residential areas. They bribed the Gov (Crist) to get an illegal agreement allowing vegas style slots.

Agreement has been tossed but they continue working to undermine the state govt.

I think the Indians have long wanted the Black Hills

They have always owned the Black Hills - and still do, by legal treaty. the United States Constitution Article 6 states; Treaties are the law of the land

It's the gov't that has 'long wanted ' them .

The gov't left the Black Hills, by treaty, to the Indians, as they considered the lands not worth much.

Then, oops, thars gold in them thar hills!

Ever since, the gov't has used evey machination and false claim they can conjure to take the lands - even claim to own it. BUT THEY DO NOT.

There are still SOVEREIGN Native American lands inside the country - like the Haudenosaunee (Iroquois) Confederacy (the Six Nations Confederacy: Cayuga, Mohawk, Oneida, Onondaga, Senaca and Tuscarora of upper New York State. They are in almost constant battle - sometimes all out battle with barricades, guns etc - to maintain their rights.

They travel the world on their own legal passports = not US passports, etc.

Neither N.Y. state nor the US gov't has ANY jurisdiction over them. Not that they don't constantly try.

The Lakota are in the process of reestablishing their sovereignty over several reservations - including the Black Hills lands - to form a confederation = they are establishing their own banks, their own energy company, etc.

Citizenship would be open to all. They, too, plan on having their own passports. Their form of gov't: a confederation that would respect the libertarian principles of posse comitatus and caveat emptor, would offer "individual liberty through community rule," and would collect no nationwide taxes - and the economy on the gold standard.

In other words, based on the form of gov't they had before the Europeans came...and is still practiced by the Six Nations.

Sound familiar? Sound like the original set up of the U.S.?

It should. When the Founding Fathers were trying to come up with a foundation for the new country, they had no experience with a free government OF THE PEOPLE. They called upon the leaders of the Six Nations and counseled with them in Albany - We owe much of our form of gov't to the Six Nations. It's all in our history, all documented, but ignored loudly.

HOwever, I hope the Lakota are successful. We may just need another 'country' to escape to in the near future.

Indian reservations are basically sovereign states and no state laws necessarily apply. Perhaps Indian nations could set up state of the art medical centers that would be beyond the reach of Obamacare regulations and offer unlimited medical care for cash.

As much as I respect the Lakota/Nakota/Dakota tribes, they are not getting my 40 acres in the middle of the Black Hills.

You'd be perfectly welcome to stay there - and you wouldn't have to pay any federal taxes.

I envy you. You could end up living in free land while the rest of us are sunk in serfdom

About 100 years later the US did the same to the Sioux. Why does the first conquest confer legitimate title and the second doesn’t?

Because of Constitutionally binding legal treaties - that, ever since the gov't found gold in "them thar hills' they have been ignoring and breaking/

They have treaties that were ratified under the U.S. Constitution, for whatever they are worth.

The Supreme Court in United States v. Sioux Nation of Indians, 448 U.S. 371 (1980) ackknowledges that the Black Hills were taken from the Sioux contrary to the Fort Laramie treaties, and categorizes the blatant theft as “eminent domain”.

It’s really just an early harbinger of the currently popular practice of twisting the constitution and laws to mean anything which is currently convenient to the the powers that be. You start by stealing land from the Sioux, and wind up with an alien Marxist Muslim as POTUS. Perhaps Barry Soetoro is merely God’s judgement on the USA, or as the Buddhists would put it a manifestation of our bad karma.

Wouldn't that be a hoot? Our country falls to Marxism, we become serfs - and we escape to live in Indian country - which will be as free as the US in it's beginning.

The point is that the whole scheme from beginning to end was for the government to own as many homes as possible - it's the Marxist way - it's how you keep a people in line.

Disclaimer: No, I don’t feel like getting involved in a long thread where I refute your frothing at the mouth assertions that our government is based on native American tribal forms and had no basis in European history or knowledge.

I’m sure the Federalist Papers were originally written on buffalo hide and translated. Hamilton, Madison and James were simply translators. I’m sure both Jefferson and Mason had real Indian names.

I’m sure if the Sioux got the land back they would then turn around and give it back to the Cheyenne, Kiowa, Crow, and Pawnee they took it from.

The courts have already ruled in their favor. They don’t own it anymore. So the court ordered them paid. You can’t right all wrongs in the past by making new wrongs. They really should just take the money and drive on.

But go ahead and think what you want. It just shows how facts aren’t used anymore. I pointed out your errors. I’ll move on now and you can slip back into your unchallenged delusions. Good luck with them.
