Scott Brown swearing-in would be stalled so health-care reform could pass

It looks like the fix is in on national health-care reform - and it all may unfold on Beacon Hill.

At a business forum in Boston today, interim Sen. Paul Kirk predicted that Congress would pass a health-care reform bill this month.

“We want to get this resolved before President Obama’s State of the Union address in early to mid-February,” Kirk told reporters at a Greater Boston Chamber of Commerce breakfast.

The longtime aide and confidant of the late Sen. Edward M. Kennedy, who was handpicked by Gov. Deval Patrick after a controversial legal change to hold Kennedy’s seat, vowed to vote for the bill even if Republican state Sen. Scott Brown, who opposes the health-care reform legislation, prevails in a Jan. 19 special election.

Oh of course. I don’t know why it didn’t come to my mind before. If he wins by a clear margin it would hopefully be hard to justify it but if it’s close enough a recount could delay things for months.

The GOP/RNC needs to be proactive, not just reactive. This isn’t 1864 anymore. If you want to fight a war like it is, you will lose, badly.

They MUST prepare their legal briefs NOW and GET THEIR ASSES UP TO BOSTON!!!

I don't see either candidate winning this thing by more than 4% - the wildcard being the independent candidate named Kennedy.

Are there enough f-tards and idiots out there to vote “Kennedy” and swing the election? I keep thinking of the Eddie Murphy movie “The Distinguished Gentleman”, although Murphy's character actually won the election, based on nothing but having the same name as his deceased predecessor.

How about this: Is this Kennedy a plant? Would he try some legal maneuver, which could further delay SB from being seated?

I put nothing past the Chicago Cabal folks.

I think that Kirk’s and Gavin’s statements make great political fodder (especially since Gavin didn’t wait 10 days to certify Nikki Tsongas when she won her special election 52%-48%), and that we should saturate the media with this evidence of Democrat hypocrisy, ham-handedness and disregard for the will of the people. However, I really don’t see any benefit to not devoting 100% of energies to winning the election and instead preparing legal briefs for a quick certification. First of all, it would be uphill to get a court to mandate that the Secretary of State certify the results until the UACAVA ballots have had 10 days to come in, and since the Constitution provides that each house is the judge of the elections, returns and qualifications of its members the Senate would not have to seat Brown until a majority of Senators was satisfied that he had proper credentials from the state and was duly elected.

But, most important, we need to stop thinking that it is a fait accompli that a health-care bill will pass the House and go to the Senate before mid-February (or at all, for that matter). If we can hold all of the votes against the bill from November, and we get just Cao and Stupak to vote against it (and there are a couple of dozen Democrats that could vote against it as well) the bill would fail (remember, Obama lost an AYE vote when Wexler of FL resigned on January 3, and he won’t be replaced until mid-April).

So if Brown wins it would put the final nail on the coffin of ObamaCare once he’s seated, but ObamaCare is in its deathbed anyhow (and won’t be revived within the next month and a half).

Let’s work for Brown’s election (which is hard enough to accomplish without taking our eye on the ball) and worry later about what happens if he wins.

Goldwater, I totally agree on devoting 100% to getting SB elected. But that doesn't preclude mobilizing for challenges beforehand. The lawyers aren't the ones pressing flesh, holding signs and manning phone banks.

There needs to be a proactive mentality amongst Conservatives/Tea Partyers/Republicans. Reactionary isn't going to work against this relentless enemy.

Blitzkrieging the bastards seems to be an effective strategy in defeating and then destroying them.

SB should arrive in DC as soon as the election has been called. Hell, he should give his victory speech from the steps of the Capitol Building!!! Or even better, give it from the plane on the way from Boston (or Bedford) to DC. Make the point immediately: I WON AND I BELONG IN THE CAPITOL BUILDING NOW!!!

I have always viewed conservatism as possessing an intellectual foundation of a blend of logic, realism and pragmatism. This attitude from some “conservative” quarters regarding the candidacy of someone like Scott Brown tears that idea to pieces.

It's not just Scott Brown, though.... you see it everywhere on FR and elsewhere. I think what we're seeing is a sort of conservative populism, rooted mostly in a visceral, emotional dislike of the direction of the country. That dislike is justified ... but there's generally not much acknowledgement of the practical issues involved in reversing the trend.

The Tea Party movement is a good example of this: there's a lot of pent-up emotion, but very little direction or political strategy beyond showing displeasure.

Sarah Palin's supporters also show this tendency: witness the real venom they display over dissenting opinions; those who are not fans, "hate" her. She is now commonly portrayed as an alternative to "elitism."

And, of course, there's the ridiculous and ubiquitous "RINO" accusation, which has the benefit of being so broad as to be pretty much meaningless: I've discovered that those who use the term are generally unable to define a "true Republican." Purity is undefined, but nevertheless required -- and that helps to explain the fractured state of conservatism.
