Woman proud of being American -- until told she's not

Angela Boneva always thought she was an American, never imagining that valued piece of her identity could be stripped away.

Because her father was born in Indiana, an American consulate in Bulgaria bestowed U.S. citizenship on Boneva when she was growing up there in 1981. It granted Boneva privileges unavailable to her Bulgarian friends, allowing her to visit relatives in Chicago and then to move to the area in 1997.

Boneva, now 34 and a married mother, settled into a quiet American lifestyle in Niles — until the day a letter arrived from the U.S. State Department, upending her world. In six indifferently worded paragraphs it said, in effect: There was a mistake. You're not an American.

Now worried she could be deported, Boneva has been struggling for seven years to solve her predicament, a journey of frustration that spotlights why a U.S. passport is such a treasured ticket for so many around the world.

"I thought it was some kind of joke," said Boneva, inside her family's modest condominium, where her U.S.-born son Ryan, 7, plays video games on the living-room TV. "I grew up believing I'm an American, and now they want to take that away? This is like a bad dream."

Thanks I looked that up and found it true. You can get citizenship revoked if you misrepresent yourself on the application. That might apply to this unfortunate young man.

You thought wrong. There are residency requirements, now 5 years, two of which must be after the 14th birthday of the citizen parent. Previously, when this nice lady was born, and when Barrack H. Obama was born, it was 10 years total, 5 after the 14th birthday.

Chances are the story is wrong about her being eligible for automatic citizenship in the same situation today, because it doesn't sound like her father made the 2 years after his 14th birthday.

Her father was born in Indiana, yet she isn't a citizen? If this is true, then Hussein is not a American citizen!

If he was born outside the US, and never naturalized, that would would be correct. Anyone born in the country is a citizen (save children of representatives of foreign countries, like diplomatic personnel) via the 14th amendment. But there are rules, actually laws, in this case, 8 USC 1401 g, which apply to those born out of the country. There is a different one for the case of an unmarried US Citizen mother, with an unknown or undeclared father. .

If she is married to an American why the talk of even deporting this beautiful lady? What a bunch of crap. We have Obamageddon who is a complete blank slate who allowed to be President (cough, cough, gag, gag) and this functioning American is questioned??? What an upended bunch of BS!! I don’t know how America can stand much more of this Fraud and his ever increasing wickedness. The man is so in love with the man in mirror and in reality he’s a disgusting puke. My understanding is that if one of your parents is American but not the other you are NOT a natural born citizen HOWEVER, if you are married to an American that gives you dual citizenship and allows you to remain in the country. I have many Canadian friends who are married to Americans and they live quite peacefully in the United States, some for many many years now. Who knows if she gave up her European citizenship and became an American? we don’t know that but since she is married to one, she has the right to stay. Not like the squatting, welfare sucking Aunt!! CO

It appears we might be seeing more stories like this, to foment a public acceptance that all regulations regarding citizenship are relative, therefore Obama should likewise not be held accountable for the citizenship issues of his parents.

Or not.

It's also possible that the opposite thing might be happening: the press will start leaking more and more stories like this and focusing on them with the express (but subtle) purpose of raising QUESTIONS about BO's past.

The only differnce I see and why the ten year rule doesn’t apply to Obama is that this lady is NOT seeking to be President of the United States. Neither did she obsfucate all of her past history. He might be trying to set a precedent that he can apply to himself but I see it as a very lame try. The two situations are not even remotely related. That because she just wants to live a peaceful life as an American wife and he wants to RULE the country illegally according to the Constitution which HE has made clear he doesn’t have any respect for. It’s lame if that’s the rationale!! CO

You are correct Canadian, but for a another reason; Obama may or may not be a citizen, but without both parents citizens, even if he was born in the U.S., he is not a natural born citizen. Natural born citizenship, as most everyone has by now heard, is a constitutional requirement for our presidents.

In case the Obama paid, or volunteer blog squad descend, lets make clear that the Constitution didn't define natural born citizen, just as it didn't define mandamus or felony or hundreds of other terms, because they were part of our common law. U.S. common law was derived, according to Joseph Story and Jefferson, and probably others, in large part from the legal principles of Emerich de Vattel, in his compendium of the laws of nations called “Law of Nations”. Jefferson began to teach the course in “The Law of Nature and of Nations” in 1779 at William and Mary College - ten years before ratification. The text, until 1841, was Vattel. Vattel was the most frequently cited legal source in American jurisprudence betwen 1789 and 1820.

One of Jefferson's students, Chief Justice John Marshall, a minuteman and representative of the Virginia ratification committee, was just one of many who repeated the definition “about which there has never been doubt” (Bingham, in 1866 addres to joint session), in The Venus, 12 U.S. 253 at paragraph 289. This a fascinating and very readable case which arose because communication in the early 19th century was slow, and a number of freighters didn't know the War of 1812 had begun until they were intercepted by British frigates. Citizenship needed to be established for the new U.S. to ascertain ownership of cargo. Marshall, one of the most readable of the founders, wanted to establish the definitions of citizenship knowing that this case law would guide jurists to come. He cited Vattel as the most concise source, and repeated that natural born citizen is someone “...born in the country of citizen parents”.

Obama’s father was an alien. Laws cannot change The Constitution. Obama can not be a natural born citizen without a constitutional amendment. This women is caught up in our legal system, and laws can be changed and overruled by judges and the legislature.

It is not automatic. My son-in-law is from Hong Kong. When he married my daughter he only had a student visa. It was a long process for him to get his green card, and now is going through the process for getting U.S. citizenship. He is using an attorney so there would be not mistakes.

There are three potential factors, Parent A’s citizenship, Parent B’s Citizenship and what nation you were born in. There is also a factor of how long you lived in that foregin nation.

Its not so straightforward.

For instance, this is one reason why the founders put the “Natural Born Citizen” clause in the constitution for POTUS. So as to best determine the loyalty of a person, and where those loyalties lay. The best way to know that someone is loyal to the US and only the US is to have two parents who are citizens, and to be born in the US. That is what a Natural Born citizen is. Someone with ONLY one citizenship at birth.

This wonderful young lady was born with two citizenship’s, US and Bulgarian (or perhaps Russian/USSR?). I am not familiar with the laws in effect at the time, but it may have been something along the line of having to choose one or the other in a certain amount of time. Perhaps her parents did not do that, and if she spent all of her life in Bulgaria up to a certain age with out moving to the states, might have lost the ability to claim citizenship. I don’t know the circumstances so I can’t say on that.

That is actually what I am saying. He doesn’t meet “any” of the qualifications for President. Just the fact that one of his parents was a foreign citizen DISqualifies him. I don’t disagree with a thing you said. CO
