Holder Failed To Alert Senate To Old Brief

During his confirmation more than a year ago, Attorney General Eric Holder failed to notify lawmakers he had contributed to a legal brief dealing with the use of federal courts in fighting terrorism, the Justice Department acknowledged on Wednesday.

“The brief should have been disclosed as part of the confirmation process,” Justice Department spokesman Matt Miller said in a statement. “In preparing thousands of pages for submission, it was unfortunately and inadvertently missed.”

Still, the “amicus brief,” filed with the Supreme Court in 2004, resonates years later as Holder finds himself defending the handling of some recent terrorism cases, particularly the interrogation of alleged “Christmas Day bomber” Umar F. Abdulmutallab.

The brief – filed by Holder, then a private attorney, former Attorney General Janet Reno and two other Clinton-era officials – argued that the President lacks authority to hold Jose Padilla, a U.S citizen declared an “enemy combatant,” indefinitely without charge.

In making their case, Holder and the others argued that using federal courts to fight terrorism, which includes providing Miranda rights to terror suspects, would not “impair” the government’s ability to obtain intelligence, which they called “the primary tool for preventing terrorist attacks.”

...After President Obama nominated Holder to be Attorney General, the Senate Judiciary Committee sent Holder a 47-page questionnaire, including a request for any briefs he had filed with the Supreme Court “in connection with your practice.”

Nope: Not one bit. The democrats were determined to pass anyone Obama wanted , and the republicans would have sat on their hands ,worried about being accused of racism.

Mistakes were made.

Briefs were left out... ...but at least they weren’t left OFF, as in the Rahm Emmanuel/Congressman Massa incident.

An estimated 250 Justice Department employees working in different locations near Washington, D.C., will be relocated to Columbia over an unspecified period.

Graham said U.S. taxpayers will save $42 million by having Justice Department employees working in South Carolina, which has lower costs than Washington.

“It was almost too good to be true,” Graham said of the plan. “But it proved to be true.”

Graham, a Republican, praised U.S. Attorney General Eric Holder and Deputy Attorney General David Ogden, both of whom were appointed by President Obama, a Democrat.

“I can’t thank Eric Holder and David Ogden enough,” Graham said, adding they offered their support for a leasing plan that was initiated during the administration of George W. Bush.

As Senator Lindsay Graham pointed out in the hearin, Holder is not big on doing homework.

It seems like an amicus brief is not something one would forget. How many other times was there an amicus from Holder??? I wonder what else he “forgot.”

They certainly are to some of us. Nobama is clearly trying to change America into a socialist/communist state, just like his buddie Hugo. Holder (as well as a significant percentage of blacks)is clearly sympathetic and covertly supportive toward arab/muslim/african terrorists and will result in another major terrorist attack here.

Holder is not an ethical man. During the Clinton administration he refused to take a referral from a federal judge who found that a Clinton appointee had committed perjury in a lawsuit on the Hillary Health Care Commission.

The flabbergasted judge could do nothing but fine the government $250,000 (the max).

Liz Cheney has been exposing DOJ regarding conflict of interest, DOJ's actions indicate they are more concerned about terrorists rights than Keeping us safe. She has taken some heat from Republicans .

Her web site Keep America Safe, and will shine some sunlight on this.

Her latest video forced DOJ to disclose names of lawyers who represented terrorists at DOJ. They had been stonewalling for months

Agree with your post. Part of stopping it is exposing it. The cumulative effect of this take over will come to a head if they Ram Health care through(IMO)

Seems like there was a master plan from the beginning. Too many pieces were ready to go, as soon as this administration took office. Obama is just the salesman.

The pitch that --we will be the most transparent in history,-- was an intentional set-up for massive deception in agenda being pushed.
