US states sue EPA to stop greenhouse gas rules [FL, IN, SC, VA, TX, AL...]

At least 15 U.S. states have sued the Environmental Protection Agency seeking to stop it from issuing rules controlling greenhouse gas emissions until it reexamines whether the pollution harms human health.

Florida, Indiana, South Carolina and at least nine other states filed the petitions in the U.S. Circuit Court of Appeals in Washington, D.C. on Thursday, states said.

They joined petitions filed last month by Virginia, Texas and Alabama.

The Obama administration has long said it would attack greenhouse gas emissions with EPA regulation if Congress failed to pass a climate bill.

The state petitions call for the EPA to reopen hearings on the so-called "endangerment finding" the agency issued last year declaring the emissions dangerous to people.

"If EPA doesn't reopen the hearings we will move forward to try to stop them from regulating greenhouse gases," said Brian Gottstein, an assistant to Virginia's Attorney General Kenneth Cuccinelli.

The states have complained that the EPA relied too heavily from reports by the U.N.'s climate science panel which included information that exaggerated the melting of Himalayan glaciers.

More Obama. What’s left to say. This is happening because Lisa Jackson (a buffoon) is EPA administrator. So those who voted for Obama voted for this fool at EPA. Elections have consequences and this wretched woman is a consequence of having Obama as president. What’s left to say?

It’s funny you said this. Over the last year, I believe I have come to a better understanding of how the Civil War started. There is such a stark difference between the states that are party to this lawsuit, and the states that think everything the EPA does is just peachy. I think it would be a lot better for our country if issues such as greenhouse gas rules — and many other issues — were settled and codified at the state, not federal level.

One more amusing 'graph from the story:
The EPA said it was confident it would withstand legal challenges on the issue. "The question of the science is settled," spokeswoman Adora Andy said. The science "came from an array of highly respected, peer-reviewed sources from both within the United States and across the globe, and took into consideration hundreds of thousands of comments from members of the public, which were addressed in the finding," she said.
No doubt.

Exactly right. Almost all the problems were having is because of federal government involvement. If Federalism worked as its supposed to, none of this crap would be happening.

Is everyone aware that the Revolt against Obama and the Commies has begun? In addition to this EPA related story, the States are also choosing to opt OUT of Obamacare.

This is just the beginning of what is coming. I don’t think the libs have a clue about what happens when The People strike back.

I’m quite happy to see it. Michigan will have a republican governor before the year is out (probably Hoekstra) and he’s pushing to make it easier to recall congressmen and will likely join in this effort to slap down the EPA.

Not sure how much traction they will get with this, the Supreme Court already ruled that the EPA must regulate greenhouse gas emmissions. Realizing that they can't effectivly do this under the Clean Air Act in the same manner as other pollution they tried to change their policy for CO2 but again got told by the courts that they couldn't, the levels they have to regulate are specificly listed in the law.

I think if the states really wanted to get the EPA to not enforce CO2 emmisions as pollution, they should try to get the Clean Air Act amended rather than waste time sueing the EPA (which is not likely to have any actual effect, they are bound by a decision of the Supreme Court to regulate CO2 as pollution).

The optics of this look better for state AG's and Governors however as it casts them in a light of "standing up to big government", really I think it makes them look foolish as there are better ways they could approach this problem. Maybe I'm wrong though, YOMV.

...I’m in Kain-tuck, moved here three year ago from Virginy, but, for the States to become truly United, the courts are the last hope...

Are you saying that a court has told EPA that they can't change the regulatory threshold for CO2 from 250 tons to 25,000 tons(or maybe 70,000 tons)?

They will get sued for such action, but I wasn't aware that a court had said they couldn't try.

Thats exactly what happened. The EPA tried to amend their regulations to change the threshold, but they got sued over that, the court told them to "read the damn law" and use a threshold of 250.

The EPA is in a bind here, if they don't enforce the mandated limit they get sued, but they can't enforce it because it would paralyze the economey.

Amending the Law is the most simple fix.

I suppose it wouldn't THAT much of a leap of logic given odinga's EPA ruling that at some point we would all have to be fitted with scrubbers to mitigate the dangers of the lethal gas we all exhale. SHEESH!
