W.H., Stupak abortion agreement

The White House and anti-abortion Democrats have reached an agreement to defusethe controversy over abortion in the health reform bill – planning a series of steps that will secure the support of Rep. Bart Stupak (D-Mich.) and other Democrats to give party leaders the votes they need to pass reform, sources tell POLITICO.

Under the agreement, President Barack Obama would sign an executive order ensuring that no federal funding will go to pay for abortion under the health reform plans. In addition, Stupak will get to state his concerns about abortion funding in the bill during a colloquy on the House floor during the debate.

And then, Stupak and several other Democratic hold-outs over abortion will sign on to the bill, the sources said. The agreement would almost certainly give House Speaker Nancy Pelosi the 216 votes she needs to secure an historic health reform vote by day’s end – capping a year-long drive to achieve Obama’s signature legislative goal.

I don’t think a guarantee from the POTUS that he will issue an executive order to veto the part of the bill he doesn’t like (particularly in exchange for votes from Congress) is constitutional. Unless this is the cover Stupak wants and no such order will be issued. Just my opinion, but I will listen to those who are smarter than me on this.

Essentially Obama is doing a line item Veto with an executive order,it could not be legal and I don’t think given his view on abortion he will follow through on his promise.

What will probably happen is some left wing group of Abortion group with challenge the Executive order and Obama will have to tear it up, while winking like railroad crossing light....

Stupak is counting on Americans having short memories. He is convinced that either he will be re-elected in November or that he or a family member will receive a cushy government appointments as payment for his deception.

All democRATs are convinced that their support for this government takeover will be repaid with either re-election or to appointments for themselves and/or family members to cushy very high-paying government positions. They reason that elections scheduled for November 2, 2010 is seven long, long, long months away and that Americans will either forgive or forget about them or their family members.

That is first semester law school stuff. You are right. An EO can’t overrule explicitly passed legislation.

Yes, and they the Dems know that. Obama and Dem Rat crew get to eat and have their cake too. They know that any court challenge against the EO will invalidate the Obama Executive Order, therefore, they still have their cake.

Stupak can't make his egregious reasoning fly...he's toast in November.
