13 STATES FILE LAWSUIT AGAINST HEALTH CARE BILL

Attorneys general from 13 states sued the federal government Tuesday, claiming the landmark health care overhaul bill is unconstitutional just seven minutes after President Barack Obama signed it into law.

The lawsuit was filed in Pensacola after the Democratic president signed the bill the House passed Sunday night.

Where the hell is Mississippi in this fight? Guess I’ll be moving back home to Alabama!

Haley Barbour announced this morning that he has given the MS AG until NOON Thursday to file on behalf of the people of Mississippi. If a lawsuit has not been filed at that time, Barbour will file one himself.

Won’t have a chance if it takes too long a time.

That's what court injunctions are for. A judge can grant a temporary injunction barring the Federal government from implementing the legislation until the litigation is over.

With other states on board to file on their own or join in, I can’t help but believe the filing of 13 to begin with was a message.

It’s possible, but by the time they run the course the beast will be on the move and it’s tenticles spreading.

I do hope though that mandatory purchase will be fought and won...and pressed hard thru the courts..yes it’s against the constitution, but aside from this these other suits seem to be time and money consumming.

Go Colorado!

I emailed my attorney general last night complaining that my state-of-Colorado approved plan, offered by a Colorado insurer via my Colorado employer for services offered by Colorado providers to this Colorado resident is being outlawed by Congress and enforced by IRS audits and IRS fines. I like my high-deductible plan with no first-dollar coverage, and I will soon be an outlaw on both counts.

A lot of the typically uninformed at work were surprised & disappointed today when I proved to them that a good portion of our plans will be taken away from them next year by the reform that “if you like the plan you have you can keep it.”

I wonder what the legal strategy behind the joint filing is. To my legally untrained brain, I would have thought it better for each AG to file a separate suit in their own federal circuits/districts (or one suit per) so as to force the USSC to take the issue up sooner rather than later, avoiding discordant circuit/district rulings.

The unified filing is being done in the rocket docket Federal court district that includes DC. The Virginia AG instigated it and other AGs signed onboard. Rocket Docket means it will land in the Supreme Court that much sooner

At the same time these same state AGs are filing in their own Federal courts, say out in Denver for the Colorado AG. Partly for regional publicity and acclaim and partly to mount a multi-pronged attack

If the USSC deems the mandate unconstitutional, then the dims will simply replace it with a VAT. It probably won’t even need a vote.

Just a thought...
