Court Martial Likely, Legal Defense Fund Established
Washington, D.C., March 30, 2010. “I am today compelled to make the distasteful choice to invite my own court martial, in pursuit of the truth about the president’s eligibility under the constitution to hold office”, said active duty Army Lt. Col. Terrence Lakin. The American Patriot Foundation, a non-profit group incorporated in 2003 to foster appreciation and respect for the U.S. Constitution, immediately announced it has set up a legal defense fund and will provide Lt. Col. Lakin with a top-flight defense team. Details are available on the foundation’s website, www.safeguardourconstitution.com.
Article II, sec. 1 of the U. S. Constitution explicitly provides that only “natural born” citizens can serve as president and commander-in-chief. Mr. Obama’s continuing refusal to release his original 1961 birth certificate has brought Lt. Col. Lakin to the point where he feels his orders are unlawful, and thus MUST be disobeyed.
Lakin has today informed his superiors that he cannot understand how his oath of office to “preserve, protect and defend the Constitution” does not permit military officers to pursue proof of eligibility from his commander-in-chief. Lt. Col. Lakin’s efforts to seek affirmation of the president’s eligibility have been rebuffed with legal evasions. Given the Obama Administration’s “transparency” initiative, many U.S. citizens are also demanding release of the original birth certificate.
Lakin serves as Chief of Primary Care and Flight Surgeon for the DiLorenzo TRICARE Health Clinic and is lead Flight Surgeon charged with caring for Army Chief of Staff General Casey’s pilots and air crew. His numerous awards and decorations include the Army Flight Surgeon’s Badge, Combat Medical Badge, the Bronze Star Medal, the Meritorious Service Medal, the Army Commendation Medal with three Oak Leaf Clusters, the Army Achievement Medal with two Oak Leaf Clusters, the National Defense Service Medal with Bronze Service Star, the Armed Forced Expedition Medal, the Army Reserve Component Achievement Medal, the Army Service Ribbon, the Overseas Service Ribbon and the NATO service medal.
Look for an invluntary discharge which will remove this officer’s “standing” to sue.

For my money, the Kenyan Usurper has spent upwards of a million bucks on legal fees to prevent any disclosure of the details of his origins, educational history, travel history, passport data, social security number(s), when all he needs to do is produce a $12 long form original birth certificate.

IMHO, about the only shot "birthers" (and I use that in a descriptive, not a derogatory manner) have is for the 2012 elections, where candidates will *NEED* to provide the long form BC by law in various states. Until then, the president has been sworn in and arguing about it is futile. Even if there *is* standing for a case, it'll never get heard. The ramifications are just too drastic.
IMHO - I figure that there's something on the BC that's politically damaging, rather than illegal. Really, does anyone think that the people who voted for BO *care* if a piece of the Constitution was circumvented? Or if there's an obscure citizenship law in HI that provides BC's for people born out of country?
Nah, it has to be something simple, that would really sink BO's boat. Something like listing him as "Caucasian", or that his Dad wasn't who he said it was, or something.

Barack Obama was born with duel-citezenship. His father was a British national by way of his Kenyan birth. This means that Barack Obama is ineligable to be POTUS.

We have been here, and done that. For purposes of litigation, it is pointless to mix the apple of the legitimate questions about the place of Obama's birth, with the orange of Natural Born Citizenship. Yes, yes. Success with either one would be the "big win," and the issues are related.
But if you want a Birth Certificate, you belong in Hawaiian Courts. If you want to challenge his eligibility because he is not a Natural Born Citizen, which with a foreign father he most certainly is not, you have to be in Federal District Court in Washington, D.C.
Of course, both can be done. Just not lumped together in one pleading in the same court. Who's the Colonel's lawyer? Anyone know yet?
I wish posters like you would also add a line in your posts that says it is very probable that he was not a dual citizen because his father wasn’t legally married to his mother...and that it is a very complicated immigration issue based on UK law.

That’s not a good argument against being natural born. What if Japan decided to give all people with ancestors in Japan are Japanese citizens at birth regardless of where they are in the world? Does that make all “natural born” Americans ineligibleto be POTUS?
You may be able to argue that he would have to revoke his dual citizenship and never have used its status for any benefit, but being granted dual citizenship on it’s own is not enought to invalidate being naturally born.
Heck if Iran didn’t like Sarah Palin becoming President they could just declare her a citizen of Iran and then make her ineligible.

Good point. If he did get Foreign Student Aid then that would invalidate his natural born citizenship OR that he lied and stole money from US Tax Payers. Either way it’s a big deal.
Nope. Officers serve at the pleasure of the President. He could, at virtually anytime, be administratively separated - that is to say that he could be discharged without facing any kind of judicial or non-judicial punishment.
But he has, apparently, filed an Article 138 complaint, which was rejected (appropriately) by command for deficiency. If he actually disobeys an order, he can and probably will be discharged. If he has already pronounced his intentions to disobey orders, he could still be facing court-martial for conduct unbecoming (Art. 133). Essentially, he's placing his retirement and his rank in peril, with this course of action.
There ought to be a class action lawsuit demanding the same with millions upon millions of Americans signing it and putting the courts on notice. How many times do we have to say outright that hiding the info with millions of dollars and attorneys invested in concealing the requested data and a court system seemingly fearful or complicit in not revealing the info is gathering steam and citizens entitled to that info that is required as written in our Constitution and has the definitive appearance of having been circumvented.
No long after he is thrown out of the military for this act of patriotism he will get a “who's he” from 99% of Freepers the next time his name comes up on these forums.

Your argument makes no sense. Here’s why.
There is a legal definition of natural born that is different from native born. Natural born means that you are the child of parents who were born citizens of the USA and you were also born in the USA, or its territories. I think you could also be born to US citizens who were serving overseas in the employ of the US government.
Nobody knows for sure where (or when) Obama was born. He has a step grandmother in Kenya who claims that she was present at his birth in Kenya. There are/were Christian missionaries in Kenya who claim that they know he was born there.
His mother was enrolled and present at the University of Washington in Seattle 2 weeks after his supposed birth.
His “parents” never lived at the address on the bogus Hawaiian COLB that was posted on the Internet.
Nobody living seems to know when, or where, his parents were married. None of his classmates at the University of Hawaii seem to remember Obama’s mother at all. She was not a regular in their gatherings.
Hawaiian law at the time of his birth allowed a relative to request a Hawaiian birth certificate, even if the child was born elsewhere to Hawaiian parents. That law has been changed, but it was in effect until he was 2 years old.
He was listed as an Indonesian citizen and adopted by his stepfather as a small child.
Newspaper articles appeared when he was elected to the Senate touting him as the “first Kenyan to be elected to the US Senate”.
All of the aforementioned “witnesses” have been silenced, either by death, or by decree of the government.
If his father really was Barack Obama Sr., the marriage probably was illegal since US law does not recognize plural marriages.
The only way he could be a “natural born” citizen is if it turned out that Frank Marshall Davis was his father, but that would make his biography a lie.

IF - he has no legal standing to be president, then I'd imagine that all of his executive orders would be vacated immediately. Any bills he's signed into law would be either null and void, or subject to immediate challenge. Would we just get a national "never mind" and forget about the past few years? I dunno. I *do* know that the stock markets would be rocked - lots of companies leaning one way (think "got to get ready for Health Care", oops, never mind....) would need change their plans 180 degrees. That'd be expensive, to say the least.
I don't know how it would affect our standing internationally, but I can't imagine that it would be positive.
And that's just the legal side. Domestically, I think that if he was tossed due to some sort of irregularity, then I think that his supporters - blacks especially - would riot. Would make LA and Rodney King look like Romper Room.
Besides, that'd leave us with President Biden. I'm not sure that's an improvement.
