Does he have a right to present a defense to the charges made that the order is illegal, because it originates from and implements broader orders by an Commander in Chief that is not legally in that position?

Top doctor refuses orders, urges Obama to show birth certificate – ‘if you have 1’

Lt. Col. Terry Lakin is the highest-ranking and first active-duty officer to refuse to obey orders based on President Obama’s eligibility.
A top-ranking, highly decorated officer in the U.S. Army says he’s now refusing all orders until President Barack Obama finally releases his long-form, hospital-generated birth certificate to prove his eligibility to serve as commander in chief.
“I feel I have no choice but the distasteful one of inviting my own court martial,” said Lt. Col. Terry Lakin, an active-duty flight surgeon charged with caring for Army Chief of Staff Gen. George Casey’s pilots and air crew. “The Constitution matters. The truth matters.”
“For the first time in all my years of service to our great nation, and at great peril to my career and future, I am choosing to disobey what I believe are illegal orders, including an order to deploy to Afghanistan for my second tour of duty there. I will disobey my orders to deploy because I – and I believe all servicemen and women and the American people – deserve the truth about President Obama’s constitutional eligibility to the office of the presidency and the commander in chief.
“If he is ineligible, then my orders – and indeed all orders – are illegal because all orders have their origin with the commander in chief as handed down through the chain of command.”
In his video message now posted on YouTube, the 18-year veteran personally pleads with the president to stop withholding the key document which would put to rest many of the doubts that continue to linger more than a year into Obama’s term.
“President Obama, I ask you to respect and uphold the Constitution. Be transparent and show your honesty and integrity. Release your original, signed birth certificate, if you have one, thus proving your birth on American soil, and thus assure the American people that you are lawfully eligible to hold the office of the presidency and serve as commander in chief of the Armed Forces.”
“Any reasonable person looking critically at the evidence currently in the public domain would have questions about President Obama’s claim to be a natural-born citizen,” Lakin continued, stating this “troubling” information has gone unanswered “because he refuses to release his original birth certificate dating from 1961 and bearing the signature of the doctor who delivered him. This burden of proof must fall upon the president.”
TheBirthers.org website was thrilled with Lakin’s refusal to obey orders, stating, “This is a game changer.”
Lakin is the highest-ranking officer to go public over Obama’s legitimacy and the first active-duty officer to do so. Others in the military who have challenged the president to no avail thus far include Army doctor Capt. Connie Rhodes and Army reservist Maj. Stefan Cook.
Yup. Nobody remembers when SP/4 Michael New refused to serve under the NWO army of the UN but they did the same thing to him. They will utterly crush anybody who refuses to march in lockstep to the declared globalist agenda. I'm sure this guy has had hundreds of other soldiers (officers and enlisted alike) whisper to him that he's doing the right thing and they're prayers are with him and yada yada yada but nobody is going to sacrifice their careers or lives to stand with him. Even if they did, they'd ALL go down in flames in the end. The system is simply set up that way.

Yes, but only in the Federal Court system (likely starting at the USDCDC for a quo warranto filing), once he's discharged, fined or receives any other punishment from the Military Court system — which he's fully prepared to do and is anticipating. At that point, he'll have all three elements required for legal Standing:

I'm sure it will be assumed at the outset that Hussein is,in fact,Constitutionally qualified.And if the defendant tries to demand that a genuine birth certificate be presented the trial judge (who,ultimately,answers directly to Hussein) will probably rule that such a demand will not be allowed.

You seem to forget that in any instance you believe you are being tasked with an unlawful order; you are to request clarification. If upon receiving clarification the order is deemd unlawful you are LEGALLY required to disobey. If no clarification is provided you are LEGALLY required to disobey. Politics has nothing to do with it. But that won't stop you from trying to obfuscate the facts...

Kenyan-born US Senate hopeful, Barrack Obama, appeared set to take over the Illinois Senate seat after his main rival, Jack Ryan, dropped out of the race on Friday night amid a furor over lurid sex club allegations.
The allegations that horrified fellow Republicans and caused his once-promising candidacy to implode in four short days have given Obama a clear lead as Republicans struggled to fetch an alternative.
Ryan’s campaign began to crumble on Monday following the release of embarrassing records from his divorce. In the records, his ex-wife, Boston Public actress Jeri Ryan, said her former husband took her to kinky sex clubs in Paris, New York and New Orleans.
"It’s clear to me that a vigorous debate on the issues most likely could not take place if I remain in the race," Ryan, 44, said in a statement. "What would take place, rather, is a brutal, scorched-earth campaign – the kind of campaign that has turned off so many voters, the kind of politics I refuse to play."
Although Ryan disputed the allegations, saying he and his wife went to one ‘avant-garde’ club in Paris and left because they felt uncomfortable, lashed out at the media and said it was "truly outrageous" that the Chicago Tribune got a judge to unseal the records.
The Republican choice will become an instant underdog in the campaign for the seat of retiring Republican Senator Peter Fitzgerald, since Obama held a wide lead even before the scandal broke.
"I feel for him actually," Obama told a Chicago TV station. "What he’s gone through over the last three days I think is something you wouldn’t wish on anybody."
The Republican state committee must now choose a replacement for Ryan, who had won in the primaries against seven contenders. Its task is complicated by the fact that Obama holds a comfortable lead in the polls and is widely regarded as a rising Democratic star.
The chairwoman of the Illinois Republican Party, Judy Topinka, said at a news conference, after Ryan withdrew, that Republicans would probably take several weeks to settle on a new candidate.
"Obviously, this is a bad week for our party and our state," she said.
As recently as Thursday, spokesmen for the Ryan campaign still insisted that Ryan would remain in the race. Ryan had defended himself saying, "There’s no breaking of any laws. There’s no breaking of any marriage laws. There’s no breaking of the Ten Commandments anywhere."
Yes... So by that "logic," the order establishing the General Court Martial that will try LTC Lakin is also illegal. What power does an illegally established tribunal have to to subpoena records, or compel testimony?
Refusing to deploy usually makes someone a hero, but questioning the Messiah makes someone a criminal.
