Yes, but only in the Federal Court system (likely starting at the USDCDC for a quo warranto filing), once he's discharged, fined or receives any other punishment from the Military Court system which he's fully prepared to do and is anticipating. At that point, he'll have all three elements required for legal Standing:

All orders issued to a uniformed member of the United States Armed Forces ultimately originate with the POTUS.If the individual occupying that office is,in fact,not qualified under our Constitution to hold that office then I would assume that any order issued is invalid.I was taught in BCT (*many* years ago) that a soldier is allowed to...in fact,is *obliged* to...disobey any "illegal" or "unlawful" order.
