WASHINGTON (AP) - A former senior executive at the National Security Agency was charged Thursday with lying and obstruction of justice in an investigation of leaks of classified information to a newspaper. Federal prosecutors said Thomas Drake, 52, served as a source for many articles about the NSA in an unidentified newspaper, including articles that contained classified information.

Made me mad that the jerk got away with it. Just another example of Bush being too nice? Or was the fear that a trial would reveal too much classified info? I am sure that whatever Berger stole was damning to Clinton and himself.
The most puzzling angle in the story,though, for me was the fact that there were no copies of the documents. How can that be?

Hmm...it really matters what he leaked. Stuff like spying on allies, or - surprise! - a supposed hostile Arab government feeding us under-the-table intelligence, those are the kinds of classified information definitely protected to the 9th degree.
Just so ya’ll know, folks have to remember that there is lots of information, old information and really bizarro stuff, like UFO records, that are maintained at NSA. Not all of it should still be classified. For example, Bill Clinton had his medical records classified Top Secret.

As in the “gave someone the third degree.”

It was a figure of speech saying that the classified information was important and if leaked could seriously damage our relationship with another nation (spying on allies), or compromise the source of the information.
Unfortunately, I learned idioms from my grandmother.
That nice woman, a superb cook, used to pronounce parmesan cheese “parmesian cheese”. And she always used the expression, “9th degree”.

In 2006 and 2007, Siobhan Gorman, a highly regarded intelligence reporter for the Baltimore Sun, wrote a series of articles about how the National Security Agency was (mis)managing a highly sensitive, very expensive collection program known as Trailblazer. Relying on interviews with current and former senior intelligence officials as well as internal documents, Gorman was able to show that the NSA's "state-of-the art tool for sifting through an ocean of modern-day digital communications" was a boondoggle of sorts -- and that the agency had removed several of the privacy safeguards that were put in place to protect domestic conversations and e-mails from being stored and monitored. A program known as "Thin Thread," which had proved its worth to the NSA before 9/11 and which contained several civil liberties safeguards, was abandoned in favor of Trailblazer because the latter program, according to Gorman's sources, "had more political support" and was a favorite of then NSA-director Michael Hayden's.A former National Security Agency executive was outed as the main source for Gorman's articles today. Thomas Drake, a long-time agency contractor and employee, allegedly provided Gorman with excerpts from highly classified documents, including a classified inspector general report that Gorman referenced in one of her articles that described the Trailblazer's programs problems and inefficiencies. Notably, the indictment does NOT charge Drake with leaking information -- just with the "willful retention of classified information, obstruction of justice and making false statements."

when he received a teaching assignment at the National Defense University ("NDU") in
Washington, D.C. While teaching at NDU, defendant DRAKE remained an employee of NSA,
but he performed his day-to-day work at NDU, not at NSA's Fort Meade facility. However, as a
NSA employee, defendant DRAKE still had access to NSA buildings and classified computer
systems, documents, and information located at Fort Meade. Defendant DRAKE worked at
NDU until on or about November 28, 2007 when NSA suspended his security clearance.
Defendant DRAKE resigned from NSA on or about April 23, 2008 in lieu of termination.
