After the joy of a wedding and the adoption of a baby came arguments that couldn't be resolved, leading Angelique Naylor to file for divorce. That left her fighting both the woman she married in Massachusetts and the state of Texas, which says a union granted in a state where same-sex marriage is legal can't be dissolved with a divorce in a state where it's not.
A judge in Austin granted the divorce, but Texas Attorney General Greg Abbott is appealing the decision. He also is appealing a divorce granted to a gay couple in Dallas, saying protecting the "traditional definition of marriage" means doing the same for divorce.
A state appeals court is scheduled to hear arguments in the Dallas case on Wednesday.
The Dallas men, who declined to be interviewed for this story and are known only as J.B. and H.B. in court filings, had an amicable separation, with no disputes on separation of property and no children involved, said attorney Peter Schulte, who represents J.B. The couple, who married in 2006 in Massachusetts and separated two years later, simply want an official divorce, Schulte said.
The drawn-out process has been frustrating for Naylor, who says she didn't file for divorce as an equal rights statement she just wants to get on with her life.
"We didn't ask for a marriage; we simply asked for the courtesy of divorce," said Naylor, 39, of Austin, who married Sabina Daly in Massachusetts in 2004.
That year, Massachusetts became the first state to let same-sex couples tie the knot. Now, Connecticut, Iowa, New Hampshire, Vermont and the District of Columbia also allow them.
Gay and lesbian couples who turn to the courts when they break up are getting mixed results across the nation.

Untying the Gordian Knot!!!!!! LOL!!
Seriously, who didn’t see this coming?
Combine homosexual activism with the culture of no-fault divorce, and whattya get???
Right on, it’s always those darn unintended consequences that bit the Libs in the A$$. Amen.
But the marriage was an equal rights statement. And that's the point. It wasn't a marriage, it was a way to rub your lifestyle into the face of your parents, your ex-boyfriend, your high school history teacher, or even just society as a whole. Whoever made you feel bad about yourself before.
And now, you just want to get on with your life with no consequences of your action. How about that.
This is ssssssssssoooooooooooooo cool. Like putting two cats into a bag and throwing the bag in aa river. I just hope the state of Texas looks out for the kid in all this. Anything happens to the kid is not an unintended consequence I would like.
Judges making law again. sigh
How can a state grant a divorce to people who are not considered married in that state.
They went to Massachusetts to get married, let them go to Massachusetts for the divorce.
Married people who are gay can get a divorce just the same as any other married people. A gay man can (and occasionally does) marry a woman, and they can divorce when they so choose. A gay woman can marry a man, and they can also divorce. Gays and straights have exactly the same rights, to marry a consenting unmarried adult of the opposite sex and to later divorce that person if they so choose. I cannot marry Heidi Montag, both because she is not consenting and because I am already married. My wife cannot marry Heidi Montag, for the above reasons and because they are both women. Those prohibitions are not what we mean by the connotation that “discrimination” has taken on, and neither is the prohibition on same sex marriage. It’s simply the definition of marriage, a definition that has lasted thousands of years.
How do you expect the state to dissolve something it doesn't even acknowledge, you ignorant liberal twit!
The thing that really gets my grits is the federal black-robes will wind up forcing the oxymoron of 'gay marriage' down own throats by their continued MIS-application of constitutional provisions.
Can’t these wretched creatures slither back to mASSachussetts and get their unholy union “dissolved” there?
I always wondered what happened to that guy:
Where’s that Karma graphic thingy when you need it?
