New Lead Paint Laws Effective April 22, 2010 (Killing Small Business Alert)

The US Environmental Protection Agency (EPA) has new lead paint laws going into affect on April 22, 2010. The new lead paint laws require any renovation work performed on houses built before 1978 to be performed by a certified contractor.......If you hire a contractor to do a renovation in your home that was built prior to 1978 be sure you hire a certified contractor. You should ask to see your contractors RRP certification prior to hiring them. Contractors performing work without the certification face penalties of $37,500 per day!

$37,500 per day? An EPA certified contractor is required? Homes built before 1978 is pretty much the entire Northeast United States. I can't possibly fathom how this will HELP the wallets of those who contract.

You are quite correct. Our government is cultivating a gigantic underground economy - - something like the citizens of the Soviet Union enjoyed.

I'm waiting for the regulators to hit garage sales and flea markets. Of course, when that happens, the big tax Democrats will blame the republicans.

I’m in Real Estate and this has already put two friends of mine out of business as renovators. The expense of getting your certification along with the “clean suits” etc. A small repair guy is usually living hand to mouth as it is.

As for home sales, this slows down the “flip property” business because of added expense for repairs. They’ll have to be passed on.

This will have a major negative affect on all things Real Estate.

I was up on this and set up my boss for a class on May 7th.

He is HVAC contractor. I couldn't get him in a training class before the 22nd.

He knows to bring in someone certified to do tear out work if necessary. Otherwise, a big fine.

I’m a licensed plumbing contractor. I just went through the certification classes held by a EPA approved course.

Folks, what a absolute joke this is. It’s main focus is to steal more money from small business. I had to paid $185.00 for the 8 hour class. But to be certified I have to pay another $300.00 to the government, i.e. EPA. It’s only good for 5 years. They have no one to police it except for the lawyers and you can be sure there are plenty of those goat sniffers.

The class instructs you to jump through all these hoops to confine & contain any dust you create while removing a window. (remember, I’m a plumbing contractor) Then we have to carefully roll up all plastic that was laid down, vacuum and then wipe down the area with a wet swifter. We have to take pictures before & after then we take all this so called hazardous lead dust and set it out at the curb for normal pick up! This is just a tenth of the requirements.

Guess who gets the bill for all this crap.....you do!

1-”The repairs are minor, with interior work disturbing less than six sq. ft. or exteriors disturbing less than 20 sq. ft”.

2-”If the house or components test lead free by a Certified Risk Assessor, Lead Inspector, or Certified Renovator”.

...rule “1” is impossible. “Six square feet” doesn’t cover a closet. “Twenty square feet” wouldn’t cover 3 planks of hardboard!
...rule “2” is improbable because an inspector will worried about liability and will usually claim the lead is present. Inspectors are already getting their asses sued off for everything else.

The most common home home improvement, replacement windows, will be more than double is cost to the homeowner. This per a buddy of mine that is in that business.

Ya’ know those gremlins at the EPA are laughing their asses off. They sure do have quite a bit of bureaucratic control.

I'm currently having a house renovated (built in 1985 so not effected by these new rules), and I asked my general contractor about these new rules. They had taken a day off the job to attend training and told me that the new rules really weren't going to effect them much; they apparently already take the necessary precautions and perform the proscribed clean-up when working with older paint.

As others have mentioned their gripe was that is was yet another license to maintain and another set of hoops to jump through. And we all know that the day-laborers will follow the rules, right?

Hey Gene, to make this requirement even more stupid, they have a form you can have the homeowner fill out AND SIGN saying they wish to opt out of all these requirements!

Guess which way all the General Contractors I would with are going to go? Still need the certification and still have to pay someone to test the paint if you opt out that way.

You’re right, either way they got you by the short curly ones.
