“I never heard of having to sign the ticket right there.”

You sign to acknowledge receipt of the citation. There is no implication of guilt or innocence

I suppose he could open up his shirt for your inspection

Sorry but that has little to do with it. I don’t have a disabled card and I have atrial fribulation at 70 years.
I’ll probably eventually need some gadget to keep my ticker ticking but there are rules involved when using those tags and he didn’t abide by perfectly legit rules of using a handicap space. A valid card/tag verifies authorization, not a photocopy and not an attitude and certainly not resisting arrest.

Ever watch COPS? The signing just is a promise to appear in court, not an admission of guilt. The guy should have just signed and NOT fought with cops. Fighting with cops IS a direct road to jail. This guy was incredibly stupid.

Apparantly somebody in the DMV misled him regarding the “photocopy” they told him to use.

I never heard of having to sign the ticket right there. I thought you either pay the fine by the due date or show up on the court date to fight it.

This has been the standard procedure
for at least a couple years now.

Rearding Atrial Fibrilation, sometimes it’s an extra sinus node. You might get that checked out now. Easily corrected although they’ll run you through the process when you’re over 80.

Being entitled to a handicapped parking permit is not the same as possessing a handicapped parking permit. According to the police report, he admitted he had lost the tag.

Instead of paying the fee for a replacement, he chose to be lazy and photocopy a tag (presumably someone else’s). It’s not the fault of the officer that a photocopy doesn’t meet the requirement of proof.

When you don’t sign the ticket, you have to be arrested. Signing the ticket is a promise that instead of being arrested right then and there, you’ll appear in court. Resisting arrest generally leads to forced compliance.

Sorry, I’m not going to make excuses for this man. If he had gotten the replacement tag like everyone else is expected to do, none of this would have happened.

Why did the guy put up a struggle over something that could be straightened out with the judge?

They’ve got me on blood thinner meds (warfarin) and check my blood level often. Guess it’s pretty common but it’s somewhat restricting. Every time I get a new med they have to start the level checks all over again, weekly etc. Several years now. I guess age is getting to me. Thanks for the advice though.

it makes sense to call ahead to a DMV office in that state

I doubt any state has live phone operators where you can get that question answered. Perhaps a few do. And the internet isn't an option for many ...

Which decision would that be?

I am so sorry. My husband is on that stuff and its awful. Be thankful you can still drive. My husband has been ill for quite a number of years now because of heart and stoke issues and his medical doctor hasn’t let him drive for a number of years now.

“At some point...enough regular citizens will have tasers too...and then react to any cop who threatens someone on the street. This is a device that invites chaos...and I can only see trouble as we move forward.”

I don’t see it as inviting chaos at all, or at least anymore than dozens of weapons the people know they can use effectively against cops at any moment (e.g. guns, baseball bats, molotov cocktails, etc.)

i’m disabled, and have plates and a placard. when I lost my placard, I requested, and was issued a replacement. I know that if I do not have the proper placard, or the car with HC plates, that i’ll get a ticket.

The security staff at work know me and my vehicles, but also know that if there is no placard or plate, that they are to tag the vehicle anyway. because that’s the law. it would be my fault if I wasn’t properly parked, and they might find it hard to explain to a real violator why one vehicle can park whilst another gets ticketed.

no tickee, no shirtee. that’s the game.

Real simple ~ "post roads".

I argue for a more narrow construction than "post roads" means power over any road, parking lot, sidewalk, etc., and anything that occurs on them.

But wildly expanding the scope far beyond the intended meaning pretty much the story of our post-Progressive era courts, isn't it?

Wildly expanding the meaning of a two word expression, the Founding Fathers themselves BUILT the National Road and what became US 1.

End of story!

No. That was within a reasonable definition of “post road.”

Handicapped parking in a private parking lot is not remotely related to the functioning of the mail system.

Uniformity of the rules regarding handicapped parking, with state reciprocity, is a pretty straightforward thing ~ easy to do.

Think of it like "UNIFORM BUSINESS CODE" ~ a state matter, but all the states have the same set of laws so that people find it easy to do business across borders.

If you would prefer a NONUNIFORM rule for handicapped parking, I suppose that could be done but all it would do would be to generate revenue for greedy municipalities.

You aren't, perhaps, a mayor?

Heh. Me, a mayor?

No...and it’s not that I opposed uniform codes. What I oppose is the federal government usurping the roles of states, municipalities, and families by constantly expanding its power.

In other words, I want a federal government that respects the Constitution.
