US judge orders ex-Nazi in Pa. back to Austria

PITTSBURGH (AP) -- A U.S. immigration judge has ordered an 85-year-old retired steelworker deported to Austria, or to any other country that will accept him, for serving as an armed Nazi death camp guard during World War II. Anton Geiser and his attorney did not immediately return calls and an e-mail for comment on the decision announced Tuesday by the Justice Department. Judge Charles Honeyman issued the 14-page order out of Philadelphia on Monday.

He was a 20 year old German draftee in 1945. It’s unlikely he was given any sort of choice in where he served.

There comes a point to move on.

Outrageous. He was only 20 in 1945. The Nazis often used young boys for guards owing to a lack of manpower late in the war. I don’t see any justice here. what could a 20 year old do in this situation.

U.S. Court Orders Deportation of Former Nazi Guard Living in Pennsylvania

A retired steelworker who served as a Nazi guard should be deported even though the United States granted him a visa in 1956, a federal appeals court ruled Tuesday.

Anton Geiser’s work as a guard meets the type of persecutory conduct banned under the Refugee Relief Act, which was in effect when he entered the U.S., the ruling said.

Geiser, 83, did not cite his Nazi ties on his visa application, but he is not accused of lying about them. Files from the period have been lost and it is not clear what questions he was asked.

His lawyer, Adrian N. Roe, argued to the court this year that guards not deemed war criminals were sometimes allowed in by the State Department. He complained that the Justice Department, in its efforts to expel former Nazis, was revisiting decisions made a half-century ago.

But the 3rd U.S. Circuit Court, which focused on the language of the Refugee Relief Act, said Geiser should have his U.S. citizenship revoked and be deported.

“We conclude, as have other Courts of Appeals, that according to the plain meaning of the RRA, concentration camp guards ‘personally advocated or assisted in … persecution,’ Judge D. Michael Fisher wrote.

Roe did not immediately return a message after office hours Tuesday.

The Justice Department had argued that Geiser’s visa approval was “a mistake” that should be corrected, however belatedly.

Geiser, an ethnic German, served as an armed SS Death’s Head guard at Sachsenhausen concentration camp near Berlin. He then was transferred to an SS officer training camp at Arolsen, where he escorted prisoners to and from the Buchenwald camp, where tens of thousands of Jews and others were exterminated. Geiser was at Arolsen until April 1945.

Geiser has lived in Sharon, about 60 miles northwest of Pittsburgh, since June 1960. He married and had three sons. In 1987, he retired from Sharon Steel.

The Justice Department’s Office of Special Investigation has been pursuing naturalized citizens with alleged Nazi ties for three decades. The office has prevailed in more than 100 cases, leading to at least 65 deportations, a spokeswoman previously said.

The U.S. gov’t after May 1945 was complicit in bringing many Nazis and SS personnel to the U.S. who were far worse.

Unless there’s proof he was actively engaged in the killing of death camp detainees and did more than perform guard duty at a death camp that would qualify as a war crime, I don’t see any justice served in this case.

Just wondering what has been the cost to U.S. taxpayers per deportee over the years?

Geez. Can I get deported out of ObamaLand (filled with idiots brainwashed by TV and ball games) to Austria?

I am not a nazi but I can pack my bags quickly. At least this old guy will be able to get healthcare in Austria. At 85 he will not get any here unless he is an illegal named Pedro.

We are a “country” of idiots who elected a Muslim who will destroy this country. This was just 7 years after 9/11. Obama will do so much damage that America may be finished.

They sure loved German V-2 rocket scientists when NASA could not find it’s a*s. NASA has been crap since the old German guys retired or died.

Of course I am no Nazi supporter, but this is sad and reeks of arbitrary injustice. All he seems to be guilty of is being a German soldier in WWII.

Germany will probably not accept him, so where is he to go?
I guess the US gov't will probably take away his social security also. It will be a courageous nation or person who offers to help him.

And he isn’t accused of any specific crime, or had any accusations of brutality by inmates? Sounds like he has run afoul of a Nazi judge. Guilt by association.
And, your right, what 20 year old wouldn’t obey orders if being shot on the spot was the punishment for not obeying them.
