Top Official Says Feds May Not Process Illegals Referred From Arizona

A top Department of Homeland Security official reportedly said his agency will not necessarily process illegal immigrants referred to them by Arizona authorities.

John Morton, assistant secretary of homeland security for U.S. Immigration and Customs Enforcement, made the comment during a meeting on Wednesday with the editorial board of the Chicago Tribune, the newspaper reports. "I don't think the Arizona law, or laws like it, are the solution," Morton told the newspaper. The best way to reduce illegal immigration is through a comprehensive federal approach, he said, and not a patchwork of state laws. The law, which criminalizes being in the state illegally and requires authorities to check suspects for immigration status, is not "good government," Morton said.

The administration is not allowed to ignore the law of the land.

Yes, this administration is allowed to do absolutely anything it wants...right up to and including genocide, if the One deems it. The law is entirely irrelevant when it comes to Obama. Entirely irrelevant.

The Democrats will never allow impeachment, even if the One goes Pol Pot on us. He can do absolutely anything he wants -- he is the first black President, he is untouchable. To be against him is to be racist...and being accused of racism is the same thing today as being accused of mass murder. We have regime based on the personality and skin color of one man. He is, effectively, a dictator. And there's not a damned thing anyone can do about it.

Since the U.S. Government refuses to do the job we’re paying them to do maybe we should just stop paying our taxes to those parasites.

This crap is going to come too a head soon and when it does its going to be ugly.

My message to the BoY president is to do your damn job and get the rest of the clowns in your administration to get their subordinates to do the same.

That’s what I was thinking as the next step.

AZ sets up an escrow account for income tax withholding and releases it or not depending on whether the fedgov upholds its part of the contract (Constitution).

Correct me if I am wrong, did this guy not swear an oath to perform his duties to the full extent of the law? And did he not say an oath to the US Constitution? Correct me if I am wrong, but if he refuses to carry out his sworn duties, can he be arrested and charged? I think if we are going to be held accountable for the Law, then so should he. I am interested in hearing from anyone who is a legal scholar on this issue. And I want to then participate in his arrest

You don't need a law degree on this one friend. If this turd Morton doesn't want to do his job he should be fired. He wasn't hired to have an opinion, he was hired to enforce the law PERIOD! Of course his real BOSS is Obama, and he was hired to enforce the law. Obama opinion is his agenda however if WE the people don't agree with his opinion, or his job performance, we can FIRE him.
Listening to Obama embarrass himself these past few days with the President of Mexico, is enough to make me vomit! We all know his opinion is the same as Mr Bush, the illegal aliens should be pampered and handed green cards and eventually citizenship. Of course thinking adults understand this will lead to more illegal immigration and soon another “Comprehensive Immigration Reform Bill”. What these left wing wack jobs want is unfettered immigration, unfettered power through population adjustment. Once the population is dominated by democrats seeking government solutions through handouts, and federal programs paid for by the working class slaves. Note the working class I speak of are individuals who earn money and PAY taxes, thus if one pays no taxes they are recipients not working class citizens.
That is why change in America must be a return to small government, fiscal responsibility, and moral decision making processes. Welfare as we know it must be ended immediately, unemployment offices closed and employment offices opened. Those who refuse to work, should be cut off.
And yes a 30 foot wall must be built on our southern border, and illegals returned to their home countries.
And any government worker who wants to ignore law, fired, and replaced immediately. Hope this helps!

This is the Federal Government that has turned into lawlessness. This seems unconstitutional and illegal. An agency cannot decide what law to uphold and which one they will not. I would sue the government.

You are exactly right. I included Tennessee in my thoughts. NOTHING from this pos. NOTHING! I can’t stand it. I just told a friend of mine that for the first time in my life, I actually hate these people SO MUCH that I actually wish they would get in my face so I could hurt them. badly.
I know the old saying, be careful what you wish for. It doesn’t even matter to me anymore. I am at the very last straw.

TITLE 8 > CHAPTER 12 > SUBCHAPTER II > Part VIII > § 1324. Bringing in and harboring certain aliens

(a) Criminal penalties
(1)
(A) Any person who—
(i) knowing that a person is an alien, brings to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated by the Commissioner, regardless of whether such alien has received prior official authorization to come to, enter, or reside in the United States and regardless of any future official action which may be taken with respect to such alien;
(ii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, transports, or moves or attempts to transport or move such alien within the United States by means of transportation or otherwise, in furtherance of such violation of law;
(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;
(iv) encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law; or
(v)
(I) engages in any conspiracy to commit any of the preceding acts, or
(II) aids or abets the commission of any of the preceding acts,
shall be punished as provided in subparagraph (B).

Can 1324(a)(1)(A)(ii) "Any person who -- knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, transports, or moves or attempts to transport or move such alien within the United States by means of transportation or otherwise, in furtherance of such violation of law" be applied to a local police officer who conducts a traffic stop and finds a driver of a car (who may be an illegal) who has other people in the car as passengers (who are illegal) under the "transports" clause?

In other words, could Arizona police officers (under the definition of "any person who" be held in violation of this law by not detaining someone they suspect to be in violation of the above clause?

(c) Authority to arrest

No officer or person shall have authority to make any arrests for a violation of any provision of this section except officers and employees of the Service designated by the Attorney General, either individually or as a member of a class, and all other officers whose duty it is to enforce criminal laws.

Does "all other officers whose duty it is to enforce criminal laws" refer to state and local police officers?

Back to 1226...

(3) Upon the request of the governor or chief executive officer of any State, the Service shall provide assistance to State courts in the identification of aliens unlawfully present in the United States pending criminal prosecution.

The governor has the power to request the federal government to assist in the determination of immigration status of detained suspects.

So, Federal law allows for Arizona police to detain suspected illegal aliens pending ICE review.

The Governor can request federal support in determining the status of detainees.

The Federal government can still refuse to cooperate with the states.
