AZ city joins officer's suit over immigration law

TUCSON, Ariz. (AP) -- The city of Tucson has joined a lawsuit by one of its police officers to block Arizona's immigration enforcement law.

The suit was filed in late April in U.S. District Court in Tucson on behalf of Tucson police officer Martin Escobar.

It appears everyone’s afraid of Mexicans. I guess if you can’t beat’em, join’em. They’ve invaded our country and now stealing it without firing a shot. Se Habla Espanol, anyone?

So if cops don’t like a law...they get a lawyer and sue the state?

Why can’t we do that with all laws then...and just make law enforcement a unnecessary thing? Then we could do the same thing with fire regulations and then dismantle fire departments. And then do the same thing with educational standards...and dismantle state schools.

If officer Escobar won’t do his duty to enforce the law, he should resign. I hear they need good cops in Mexico, apparently where his real loyalty lies in any case.

In addition to any other form of oath or affirmation specifically provided by law for an officer or employee, before any officer or employee enters upon the duties of his office or employment, he shall take and subscribe the following oath or affirmation:

State of Arizona, County of ______________ I, ____________________ (type or print name)

do solemnly swear (or affirm) that I will support the Constitution of the United States and the Constitution and laws of the State of Arizona; that I will bear true faith and allegiance to the same, and defend them against all enemies, foreign and domestic, and that I will faithfully and impartially discharge the duties of the office of _______________________________ (name of office) ________________________ according to the best of my ability, so help me God (or so I do affirm).

Doesn’t a person have to have standing to sue over a law like this?

How has Officer Escobar been harmed by this law? Well, he hasn’t been harmed.

It is all nonsense.

Sec. 1252c. Authorizing State and local law enforcement officials
to arrest and detain certain illegal aliens

(a) In general Notwithstanding any other provision of law, to the extent permitted by relevant State and local law, State and local law enforcement officials are authorized to arrest and detain an individual who - (1) is an alien illegally present in the United States; and (2) has previously been convicted of a felony in the United States and deported or left the United States after such conviction, but only after the State or local law enforcement officials obtain appropriate confirmation from the Immigration and Naturalization Service of the status of such individual and only for such period of time as may be required for the Service to take the individual into Federal custody for purposes of deporting or removing the alien from the United States. (b) Cooperation The Attorney General shall cooperate with the States to assure that information in the control of the Attorney General, including information in the National Crime Information Center, that would assist State and local law enforcement officials in carrying out duties under subsection (a) of this section is made available to such officials.

This is only delaying the inevitable - the law will eventually be ruled constitutional. Especially when that state law is only invoked AFTER a lawful encounter by police precipitated by an unlawful act by a perp.

Otherwise, any state law that upholds enforcement of a federal law would be void.

Why, oh why, does no one get tried for treason anymore?

Because this attempt at undermining AZs attempt to simply enforce the US laws is treason, pure and simple.

What next? Cops don’t like the Cocaine laws so they sue over that? Cops think the speed limit should be 90, so they sue over that?

Cops had such wide discretion anyway. If this Escobar cop had a suspect he didn’t have to bring him in. Just like cops don’t have to stop any particular speeder or arrest anyone for possession if they don’t want to.

Because the crime of treason is Constitutionally defined, specifically, as "making war against the United States, or in adhering to its enemies, giving them aid and comfort."

I believe that is word-for-word; my apologies for any errors. Until such time as either A) there is a war declared by the Regress, or B) the United States publishes a list of enemies that is useful at law, there is no way (lawfully speaking, of course) to prosecute jerkoffs like Escobar for treason.

Doubtless, with a bit of imagination, he could easily be prosecuted for either 'swearing a false oath', 'deriliction of duty', or 'being an asshole'. The question always is in such cases whether there is the political will to prosecute.

This law is intended to make cops do their job and ask to see some ID. Some cops just don’t want to inforce the law. You have to wonder why are we paying them if all they want to do is write tickets?
