McDonald’s vs. mac and cheese

A pair of San Francisco Bay Area restaurateurs were all set to open their macaroni and cheese specialty restaurant with the name Little Mac when a phone conversation with legal counsel for McDonald’s derailed their plans. It seems the burger giant doesn’t take kindly to restaurants that use “Mac” or “Mc” in their names, citing brand infringement.

Rather than fight, the mac and cheese entrepreneurs, Erin Wade and Alison Arevalo, have put a call out for help in finding a new name.

I am reminded of McDonald's vain attempt to defend the name "McDonald" as a trademark in Scotland. The Laird McDonald threatened to forbid them from using his name in Scotland if they continued harassing businesses owned by other members of the Clan McDonald for using the family name. I think it was a stand selling sausages that was at issue.

The word MACARONI is a generic product name, like GASOLINE or OIL, and cannot be copyrighted.
I submitted “MACARONI PLUS”.
I’m not a lawyer, but I think that while you couldn’t copyright the “WORD” you could copyright the PHRASE.
Who knows? Also, this little company couldn’t in a million years afford this much publicity. They’ve already won.

There are 2 things in this life that I am always searching for ... the perfect cup of coffee and perfect mac-n-cheese (homemade of course). That picture looks so good ... THAT might be it ... if someone has the recipe.
