The developers of the controversial mosque proposed near Ground Zero own only half the site where they want to construct the $100 million building, The Post has learned.

I keep hearing about this for days but no mention about the ownership
Supposedly Con-Edison owns some of it.
“Does he have some sort of agreement with Con Ed?”
I might be wrong, but I think Con Ed released a statement last week to the effect of they were fine with the mosque going ahead, even before the sale was completed.
PING TO NYC Mosque property not owned by applicants.Con Edison is in the mix.
This is absolutely GANG BUSTERS. They were ot even supposed to file for a building commission application without ownership, or an agreement of purchase and sale in place on the entire property.
To put it bluntly, if this ownership discovery is true, this whole application and its approval is NOW absolutely facked!
The public service commision would have to review the sale of all utility owned buildings, and that in itself will take at least 6 months.
Sorry, no mosque will be nuilt here. And besides, the Public Service Commission could codemn the adjacent block and start state expropriation proceedings, I’d love to see that!
Con Edison needs to expand its space!
Ah, here it is:

“Consistent with the law and our core beliefs, we are in the process of selling a property which had once been used as a substation. Under the terms of a 38-year-old lease, the current tenant of our property has rights to use, alter, demolish or renovate the building, as well as purchase the property. He has exercised his option to purchase the property at a price to be set by an independent appraiser. If that party meets the price as set by the appraiser, this transaction will proceed. We are following our legal obligations under the lease. We will not allow other considerations to enter into this transaction. This is New York, a richly diverse city. Con Edison’s values call for respecting people without regard to their racial, ethnic or religious orientation. They are all our customers.”

One of the two buildings on Park Place is owned by Con Edison, even though Soho Properties told officials and the public that it owns the entire parcel. And any potential sale by Con Ed faces a review by the state Public Service Commission.
We never heard anything about Con Ed whatsoever, said a stunned Julie Menin, the chairwoman of Community Board 1, which passed a May resolution supporting the mosque.

These clowns are dumber than the Iranian military ;-)
You are correct on all counts. The approval is null & void.
The developer has a 99 year lease. It would depend on how many years are left on the lease. Properties are built on leased property every day.
In my experience a lease allows the holder to do anything it pleases with the property so long as it is returned in the original state (or accepted as better) at the end of the lease.
Abdul has leased the property for about sixty years so I am sure that the mayor, the islamists, muslim-in-chief, and Con Ed, consider it a moot point.
Since the property has been used as a clothing outlet for some time now the likelihood of the utilities commission changing things is simply for show.

MestaMachine to Bokababe
Because they might HAVE to back down. If I recall correctly, they do not own the entire parcel of land where they want to erect this eyesore. ConEd owns the other half.

Yes, but the Stete Public Service Commission must review and approve the sale. It looks like no such review has been made. There is no clear authority to sell the property under lby the party leasinngtheproperty from Con Ed, even with the Con Ed approval.
Without that review, the building application will have to be brought again because the whole ball game has changed.Utilities cannot sell property without State Approval. And that approval has to be granted before the buiding is made, simply because those in opposition need to be able to include public utility based issues.
It does not change the fact that the public utilities commission has jurisdiction. And the public utilities commission had to review all of the repairs made to the Manhatten power grid after the Twin Towers were destroyed.
I am sure they will have their say. Ad I look forward to it.
so the question is: Can the American people purchase the rights to this property so that this disgrace cannot come about?
If this thing gets built and sometime thereafter it catches fire and someone calls the FDNY...
I ain’t saying, I’m just... You know?
Ah, this explains much. Thank you!
This community board is a crock, and every member should be voted off. Probably inclusive of a bunch of liberal rockheads. The 9/11 attack caused enormous suffering in this area of Manhattan. Who are these leftist fools to tell the people who live there that they now have to deal with a mosque.
The board is very unprofessional. Its a 130 million dollar building and they never even had an abstract of property title with the application? SHeesh!
If half of the block is under leasehold from Con Edison which contains a purchase option, the exercise of the option triggers the jurisdiction of the State of New York Public Service Commission:
Without approval of the state board, the issued approval for the mosque is null and void. They will have to start all over with another application. The fact that Con Ed approves of the exercised purchase option to the lessee has nothing to do with it. This was an attempted end run around the State Board.
The State Board had to handle review of all the power cable damage repair to Manhatten after 9/11.
The name of the State board is [The New York State Public Service Commission]
One glance at their roster shows that the Commission has a history of keeping Con Ed honest, a lot of review cases:
