The Federal Constitution expressly provides for the federal government to create a federal military and defend the country. Article I, section 8 expressly conveys to Congress the "power" to "declare war" and "raise and support armies" as well as a "navy"

Actually that's only partially correct with respect to the Army. The passage states: "To raise and support Armies, but no Appropriation of Money to that Use shall be for a longer Term than two Years;"

Joe Miller, a decorated Desert Storm veteran, Bronze Star recipient, and Yale law school graduate, engaged in a debate with Republican Party hack Lisa Murkowski. At one point Joe Miller asked Murkowski why she continued to support programs that are outside of the constitutional mandate of limited federal government... Her response reveals much about her lack of acumen and why she was reportedly inept as a lawyer. Murkowski responded that the nation would be in a difficult place if it only funded things that were explicitly authorized in the Constitution. She said, "I'll give you a very specific point. In our Constitution it specifically provides for funding for a Navy and an Army, but it does not specify Air Force. Are we to suggest that perhaps we should not be funding our Air Force because it's not included in the Constitution?"
In that case, Obama and the other opponents of the F-22 are bigtime Constitutional literalists. Thanks onyx.

I hope Miller can win; the McPain renomination on Aug. 24 will be all the news. Maybe there is a small hope for AK but none for AZ. People in AZ would jump over the Grand Canyon to get more pain from McPain.

The alleged example of the existence and maintenance of an Air Force as a power assumed by the federal government which is not given to it by the Constitution was a foolish statement by Murkowski. Usually that kind of ignorance regarding the Constitution comes from the Democrats these days.

Even if the Air Force is not explicitly mentioned in the legislative powers granted to Congress by Article I, Section 8, it can be easily justified under the "necessary and proper" clause, in relation to the power to "provide for the Common Defense."

As for Murkowski, she is showing that her original appointment to the Senate by her governor father was a case of nepotism.

Sarah Palin, BTW, was interviewed as a potential candidate for that vacant Senate seat at the time, but was passed over for the governor's daughter. Not surprising that Palin is endorsing Miller in this primary race.

Which is why the Constitution expressly authorizes the funding of an army and a navy. No air force in mentioned so a strict interpretation that only powers expressly granted Congress are allowed would seem to indicate that the U.S. Air Force is an unconstitutional organization. Now if you want to say that the authority for an air force is implied under Article I, Section 8's power to 'provide for the common defense' then you leave wide open the implied power to fund almost everything under the sun under the next part of that clause, to provide for the general welfare.
