Federal court revives enforcement of "don't ask, don't tell"

WASHINGTON — A federal appeals court on Wednesday temporarily stalled the landmark court decision allowing openly gay recruits to be accepted into the military.

In response to an emergency request from the government, a three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco issued a one-page order allowing the Pentagon to continue enforcing the "don't ask, don't tell" law, which bars openly gay, lesbian and bisexual service members.

The decision returns the law to the status quo before a U.S. District Court judge in California prohibited its enforcement. It will be in effect while the court considers whether to issue a longer stay, until February, when the 9th Circuit will hear the full appeal.

A decision about the longer stay could occur next week; the Log Cabin Republicans, which challenged the law, was told to prepare briefs on the issues by Monday. A "minor setback" The stay almost certainly means the government will go back to enforcing the law as it did before the lower court issued an injunction against don't ask, don't tell. Dan Woods, the Log Cabin Republicans' lawyer, called the stay a "minor setback" and predicted victory on the question of the long-term stay. "We didn't come this far to quit now," he said. Military recruiters began accepting openly gay and lesbian applicants Tuesday, a break with the long-standing policy that required gays to keep their sexual orientation a secret. Many saw it as a landmark moment in U.S. history.

Being in the military, I can't really say exactly what I want, when I want to say it, but let me ask if any of my fellow Freepers are as concerned about this decision by our amazingly intelligent and wonderfully knowledgeable federal courts? Off the record -it really concerns me that this issue is taking the front seat to some of the more pressing issues that we have in the military...AKA "How can I get these soldiers better gear to stay alive longer and do their jobs?" or maybe "How can I insure these soldiers get proper down time between deployments?" Correct me if I'm wrong, please, but this seems to me like one of these classic cases in which the Powers-At-Be fix something that "ain't broke." In my opinion: Homosexuals should serve their country if they want. Sexuality, whether hetero or homosexual has no room in the ranks. It can be detrimental to the mission in that it is a distraction. That being said, why would I or any other soldier want to know if my female team mate is homosexual?

Just some thoughts...PLEASE tell me if I'm wrong here, and why.

The fact you lead off with this on your first day, I would have to guess you are a troll looking for a comment to discredit the site.

Here's mine: Homosexuality is a disorder, not an identity. The politics that got the condition removed from the DSM doesn't change the disorder. Honest science will return it. See NARTH for some background.

It is a corrosive lifestyle and the reason to promote it is to corrode the military.

I would think the biggest question is why the Military continues to take orders from a seditious traitor who’s usurping the commander-in-chief position. It’s not every day you see your leader doing the “bro” handshake with rutheless dictators, bowing to sheikhs, and continuing to place Mexico and other South American countries in front of the U.S. and its states.

Next up is why the Military continues to accept the fact their absentee ballots are being thrown out during every election.

Next after that is why the Military continues to waive their rights to trial by jury in countless military tribunals. And of course the loss of over half the rights guaranteed under the Bill of Rights, regardless as to whether active duty personnel are dumb enough to waive these rights.

Everything else like “working conditions” (boo-hoo) and gays sound like a bunch of whiney blubbering in comparison.

The very fact that a person is a homosexual would be sufficient grounds for me to deny him a security clearance.

Homosexuality and all of it's related cousins are mental disorders and have been recognized as such by most civilized societies throughout history.

Just one example. The soldier that leaked the Afghan war documents to wikileaks is a homosexual that was planning on having a lopadichophomy after separating from service. He was openly homosexual, no doubt with white house approval and was carrying on with a superior male officer with whom he had a fight. That may have precipitated an "I'll show them" which may have lead to this huge intelligence fubar.

If homosexuals want to serve their country they can volunteer at USO shows.

You are right that there are far more important things to worry about and this is not about "equality", it's about destroying the US Military. Some of the same leftist groups that give aid and comfort to the enemy support homosexuals in the military.

It is stressful to serve in the military. Why force homosexual rights in the military? It will only add more stress and more pranks and more hate. Obama is sick to push gay rights in the military. It is not a place to play games with people’s minds.

I’d take it a step further and add that the gay initiative in government is designed to pummel the majority into submission.

Jus like the new muslim initiative is designed to pummel the majority into submission.

In other words, the gay initiative is designed to assert the leftisits’ power and has nothing to do with gays.

Now the government is into the muslim initiative and guess what gays will have to knuckle under to the government even though Muslims think gays are perverts. It’s all about the power.

In the real world, the military should be a highly trained, motivated and cohesive organization. Anything detrimental to that end is destructive of the military mission.

If you want the military to be fair at the cost of morale and readiness you certainly have that privilege. But, if you want a military to be at the top of its capability, you have to take the necessary actions to keep it there.

Do women in the service have a right to deny male service members the right to shower in the same time frame and showers as the women (and vice verse)? Common sense would tell you that most would be offended if that were done.

So, would a hetero male be offended by showering with a known homosexual? I dare say most would.

One may claim it is only fair but I would say it is detrimental to the mission of the military.

Popular or not, that is my honest opinion. And, that is from a veteran.

A Military Chaplain has a bible study and a scripture comes out in the study that goes like this: "Do you not know that the wicked will not inherit the kingdom of God? Do not be deceived: Neither the sexually immoral nor idolaters nor adulterers nor male prostitutes nor homosexual offenders nor thieves nor the greedy nor drunkards nor slanderers nor swindlers will inherit the kingdom of God.

There is a homosexual in attendance at the bible study and he complains to his commanding officer that the chaplain is promoting homo-hate speech.

Will the Chaplain be allowed to keep the integrity of his faith by holding to the teachings of his holy scriptures or will he be punished for "hate speech?"

It is not about forcing gays in the military. It is about asserting leftist power ON the military. Big difference.

The wjole gay thing started with treating gay people with a bit of dignity. When the leftisits saw that a majority bought into that, they latched onto the movement and turned it into a weapon to assert their power.

It is very hard for the ordinary citizen to imagine that there are a group of people who live to assert their wills on others just for the fun of it. It is how they get their rocks off. Don’t look any farther.
