The Ninth Circuit Court of Appeals has overturned Arizona’s requirement that people show proof of citizenship to register to vote.

The split decision by a three-judge panel determined that the requirement to show proof of citizenship — passed by voters in 2004 — is not consistent with the National Voter Registration Act.

I’ve been wondering for a long time now, how do I prove my citizenship?
My retired Army ID card? No, I don’t have to be a citizen to serve 20 years in the military, but I’d like to see it. My driver’s license? No, with a green card I could get a license. Birth certificate? No, it only has name, date and place of birth – nothing to show it’s mine.
I in no way support non-citizens voting but wonder how it can be controlled.

I would expect the Supremes to overturn this on appeal.

I’m not a lawyer, so I’ll pose this question to those with more legal knowledge. What would happen if AZ just told them to stick the decision and continued requiring proof?

In theory, the federal court could hold them in contempt of court and send U.S. Marshalls to arrest them.

Associate Justice Sandra Day O’Connor is more at home in SF than Arizona. I’m sure it pained her not to throw out the entire law.

All I needed to register was a driver’s license, so I don’t think the burden of proof is all that rigorous.

That was President Lincoln to Chief Justice Taney.

Here is a link to the opinion: http://www.courts.wa.gov/opinions/index.cfm?fa=opinions.showOpinion&filename=395479MAJ

This opinion is even worse than is being reported. The 9th Circuit had previously upheld this law. As Kosinski makes abundantly clear in his extremely lucid dissent, the two judge majority chooses to ignore binding(not persuasive) precedent in reaching their decision. The majority decision is thus the very epitome of judicial lawlessness.

This opinion will likely be reviewed and reversed en banc. And if not, it seems likely to be added to the long list of cases which the Supreme Court has reviewed and reversed.

Even in Texas we’ve got people who want to give driver’s licenses to illegal aliens.

I however have to provide multiple forms of ID and HAVE to present my Socialist Security card in person. No kids but it is a nannystate “deadbeat dad” law. I am guilty until proven innocent.

Damn FRiend, you draw too many conclusions from a single post.

I've heard about reading between the lines but you're taking it to a whole new level.

“So was the decision that ‘proof of citizenship’ is not required however a photo id is still required?”

IDs can still be used for various purposes apart from citizenship, including establishing age and residency. Until those requirements are declared unconstitutional, i guess there’s a use.

“So Arizona should require proof of citizenship in order to get a photo ID.”

But that’s, um...against due process. No, wait, equal protection. No, uh...interstate commerce? General welfare?

I'm bashing Bush...OK? I'm answering for the other poster that apparently chose not to answer or couldn't.

The million of illegals were so emboldened by Bush, millions of them marched through our streets, pushing foreign flags in your face, while making demands...It was Bush that publicly came out in support of this epic violent invasion, and they when Americans enough Bush BS, he called them vigilantes.

So it's me...I'm Bashing Bush...Any problem with that?
