Court saves tortured Nigerian from deportation

(10-26) 13:18 PDT SAN FRANCISCO -- Immigration officials who ordered the deportation of a Southern California woman to Nigeria told her she could avoid torture in her homeland - where police had repeatedly raped and beaten her decades earlier - if she refrained from dissident political activity.

That prompted an indignant ruling Tuesday from a federal appeals court in San Francisco, which said the law protects both free speech and the right to be free from brutality.

Josephine Edu "cannot be forced to choose between her conscience and torture," the Ninth U.S. Circuit Court of Appeals said in a 3-0 decision shielding her from deportation.

Edu, 47, who lives in the Los Angeles area, entered the United States in 1989 and became a legal resident in 1993 after marrying a U.S. citizen. But she was ordered deported after being convicted of assault with a deadly weapon in 2002 for slashing her work supervisor with a piece of glass, the court said.

Her appeal relied on an international treaty that prohibits a person from being deported to a country where he or she is likely to be tortured.

Whose law? An international treaty? Well send her to some other country that signed the treaty if they want her. She probably has an attorney that was paid for out of our pockets as well for both her criminal defense and deportation.

3rd story in the last week

1. Jamacian who served in US military...(busted on drug charges but nevermind that)

2. Battered woman from El Salvador...(she’s been running around without a drivers license, had a hit & run and ...well you get the idea)

3. Now this...a “tortured” woman. Didn’t read the whole article so don’t know if any criminality exists in her background. Probably a stellar ‘illegal’ citizen though. /s

Wonder what tomorrow’s illegal will sound like.

They all claim they face danger at home.

Many claim that, and they don't even need to lie. 3rd world is a dangerous place for everyone - for citizens and for foreigners, for honest people and for criminals, and for everyone in between.

This, however, shouldn't mean that anyone who is in any danger somewhere else has to be instantly admitted as a refugee. A violent crime should certainly be a big red flag just a notch below being a known terrorist.

Yeah. We dumbass Americans will take her. The Nigerians sure as heck don't want this ignorant moron in their country. I don't blame them. The 9th Circus strikes again!
