The 44-year-old Rubidoux parolee arrested last night on suspicion of murdering a Riverside policeman is being held without the possibility of bail and could be charged with offenses that would pave the way for the death penalty, jail records show.
Earl Ellis Green was arrested at 8 p.m. Tuesday and booked into Robert Presley Detention Center at 3:41 a.m. today for investigation of murder with at least one "special circumstance," an allegation that -- if it results in conviction -- enables prosecutors to seek a punishment of either death or life imprisonment without the possibility of parole.
Among the list of special circumstances listed in the California Penal Code is murder of a peace officer.

I’ve never had much use for laws that say someone’s life is worth more than someone else’s.

Actually a lot of guys facing a death penalty or life without parole go for the death penalty here is CA. The CA death row has better accommodations/food than your standard CA maximum security prison plus your chances of dying of old age on death row before CA actually kills you makes this a no brainer for anyone facing a capital crime conviction. CA is sooo screwed up!

California has some of the strictest criminal law penalties in the country, in addition to three strikes laws. That's why cities like Los Angeles and said San Francisco have considerably less crime per capita than cities like St. Louis, Dallas and Atlanta, etc, etc.
Just by that info tells me about the Justice system in this country. But then again, NO SURPRISE! stories like these are happening too often. It is only recent cases like these are aware- at the same time lives lost in the process. Sad & Sick at the same time!
Yes, we have criminalized every taxpayer everywhere for anything. We have more laws not enforced then most countries 1,000 years older then us. but
What does that have to do with the union police that supported the election of gov and AG that oppose the death penalty and then tell us he might get it. He won’t.

I think you will find Green killed the cop due to the fact he was a two-time loser and with California three strikes laws he was likely facing life in prison for vehicle theft.
There have been many cases in CA where “special circumstance” charges were filed not related to Police killings. This one appears to be enhanced to special circumstance due to the murder being committed to escape the law. [A parolee in a stolen truck.]

For most states with first-degree murder and second-degree murder statutes, a special circumstance is usually applied to the murder charge to make it a first-degree offense. For example, financial gain, the use of torture, a murder where rape is committed as well, kidnapping and murder committed to escape the law. When a special circumstance does not apply the murder is typically seen as second-degree murder, or may even be reduced to manslaughter.
