Well, it was only a matter of time. But people are pushing back because … for the most part they don’t think this makes them safer. This is just one of the stories on the new TSA pat downs. Steve has posted on it here. But the push back from travelers, flight attendants and pilots continues. HS Secretary Janet Napolitano has asked for cooperation from travelers … but that’s easier said than done. Witness the push back from a San Diego traveler.

Even headline writers use the most newly minted ghetto slang — “junk”? My junk sits out at the curb every Tuesday night. Not that I want to “disrespect” my “junk” or anything.

TSA promises $10,000 fine for refusing sexual assault

At the San Diego International Airport yesterday, about one-fifth of the travelers were selected for sexual assault by transportation security agents. Though TSA’s website did not list SAN as one of the airports employing the carcinogenic naked scan or a full body rub down, one man was told his refusal to submit would result in a civil law suit and a $10,000 fine. Under 49 CFR Sec.s 1540.105 and 1540.107, as summarized in these 2004 TSA Sanction Guidelines, apparently TSA has Congressional support to fine people for refusing to submit to molestation.

John Tyner posted his video of the incident and described in detail the experience. At about 3:50 into the first video, Tyner tells TSA agents:

“If you touch my junk, I’m gonna have you arrested.”

“Upon buying your ticket, you gave up a lot of your rights,” said one TSA agent (~8:34).

“The government took them away after 9/11,” he countered.

Several years ago, a woman had a cake server from her wedding reception in her carry on baggage. The TSA made a fuss, but allowed her to keep it.

Some time later, she received a fine in the mail from the TSA. I think the fine was $2,500 or thereabouts.

Also, you’re not allowed to withdraw from the screening process once you start. Fascist, like you said.

I bet you these clowns on CNN defending the TSA in this video were also vocal critics of the Patriot Act. The hypocrisy is palpable (no pun intended).

You do realize that the airlines & TSA will have extra staffing that day anyway?

It may not be all that much of a disruption in some airports.

Sorry, but you are incorrect, travel is not a right. Rights are those actions that you can conduct on your on without dependance on others. For example, you have the right to speak your mind. You do not have the right to have your opinion published in your local news paper because that is owned by someone else.

While you do have the right to move about this country, you do NOT have the right to demand that your neighbor, a local taxi or some other commercial enterprise transport you.

Freedom of Association includes the freedom FROM association, and should a commercial enterprise decide NOT to carry you, on their private property, then they have the right to refuse you service.

We should all ask for a line up of the TSA personnel and ask for the best looking ones to pat us down. There used to be a cute brunette at Denver. I wonder if I could request her?

What are the chances the new “discreet” pat-downs are just a ploy by Big Sis to get us to conform to the body scanners? After all, which one is more humiliating? Being fondled in public or having someone in another room see your “junk”? Both are incredibly offensive, but perhaps this is a calculated tactic.

I wonder if this guy will be placed on the no-fly list?
If he is fined we need to start a legal defense fund for him. He sounded in an interview this AM that he was already legally briefed, but he will need a lot of mullah to fight the USG.

I am surprised no one has mentioned the rest of the story. On the way OUT of the airport, after his airfare had been refunded, some other federal agent comes up to this guy and says . . .

HE HAS TO GO BACK TO THE SECURITY AREA AND COMPLETE THE BODY SCAN OR ELSE BE FINED UP TO $10,000.

Yes, this is very disturbing. What it means is that once you start the sceening process, you are their prisoner and you can't leave. So let's say you consent to go through the scanner and it doesn't show a good enough image, they may send you to be patted down and you can't refuse. You can't change you mind and leave the area.

They allowed this brave man to leave the area and then they changed their mind and went after him and tried to force him to complete the scanning, since he had started it.

The rationale being that a real terrorist could try to get through with a real bomb, refuse to consent to a pat down, leave the airport and try again another day.

This is why we need to profile based on behavior, appearance, ethnicity, religion, country of origin, type of payment (i.e. cash), prior flying history, profession, etc.

The general understanding is that the scanner will not detect the explosive the underwear bomber used.
