Wednesday, November 24, is National Opt-Out Day for travelers at airports. According to the National Opt-Out website, the goal of the day is:
...to send a message to our lawmakers that we demand change. We have a right to privacy and buying a plane ticket should not mean that we're guilty until proven innocent. This day is needed because many people do not understand what they consent to when choosing to fly.
But Homeland Defense Secretary Janet Napolitano criticized the move, calling it "counter-productive", according to an article at Politico.
Speaking to reporters, Napolitano said the agency would make adjustments or changes when called upon, as long as the safety and security of passengers could be assured.
Napolitano said that only a small percentage of passengers were being patted down by TSA agents, and:
Nonetheless, I think we all understand the concerns Americans have. ... Most Americans are not used to a real law-enforcement pat-down like that. So, as we move forward, of course we will listen to concerns.
The reason most Americans are not used to such treatment is that most law enforcement officials believe in the concept of "probable cause", and abide by the Fourth Amendment to the Constitution, which reads:
"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."

Civil disobedience is (and has been) the only response to this government out of control. I’ve been advocating it since Spring/09, but even this planned act will probably be tepid on Wednesday. Americans don’t appear to be ready to do much more than use old methods with an administration that won’t respond to old methods.

The belief of law enforcement agents is entirely irrelevant. The 4th ammendment limits the power of the state. Why can't folks understand this distinction. It is not subtle. Our forbears fought a revolution for it.

Give it some time. The dude coming up with all the bombs has a new twist: The anal bomb! It was already used in Saudi a while back. He made a bomb that would fit, er, uh, you know where. Then, convinced his brother to give it a try. It didn't kill the Saudi official that they wanted to kill, but the brother is dead as a doornail. The TSA is operating based on last year's tactics, IOW, completely defensive. Wait until the anal bomb comes here and the TSA adopts digital rectal exams as part of security screening. When that happens we'll see if Americans have true grit.......
