Uniform Code of Military Justice (UCMJ) ART. 125. SODOMY
(a) Any person subject to this chapter who engages in unnatural carnal copulation with another person of the same or opposite sex or with an animal is guilty of sodomy. Penetration , however slight, is sufficient to complete the offense.
(b) Any person found guilty of sodomy shall be punished as a court-martial may direct.
Would repeal of DADT nullify this punitive article? There seems to be difference between stating one's sexual preference and being observed demonstrating that difference.

"Would repeal of DADT nullify this punitive article? " The short answer is no. However, if DADT is repealed, the lifespan of Art. 125 is probably not very long. If the appellate courts affirm the recent prohibition against DADT, then I'd say Art. 125 would be struck within a few months.
You might be surprised that very few (virtually none) separations under DADT include this particular specification. Almost always, it's used against someone who is engaged in heterosexual relations, albeit not always consensual relations.

I ran Norton right after posting this and went to bed. My computer had a full scan three days ago. Normally it finds one or two tracking cookies and that’s it. This morning it showed 66 resolved problems.
Who runs the Defense Department computers? Porn companies? I probably will have to find a source that filters out the bugs to read the original documents.

I don't hate gay men or gay women, and I'm sure they have contributed in some good ways....but you can not allow heterosexual men to live with, bathe with, sleep in the same room with, etc with FEMALES... and NOT expect consequences......
so why do they think openly gay men won't be as disasterous to heterosexual men?.....they pursue young men, period...they oogle young men... the male creature is by nature whether gay or straight, constantly seeking sexual fulfillment ...IT'S WHAT THEY DO...and its natural ..
what a disaster...I wouldn't have my kid join a group that allowed such blatant danger...

I have to add that I feel sorry for young men these days....men need to have time to be with other men in MASCULINE ways, to bond, and the services have played a big part in that development..Political correctiness is destroying that opportunity. ...now its all one big open attack on their sexuality, their Christianity, their values, their morals....

I'm not sure I understand: where did this poll come from and where did the poll come from that states everyone in the military thinks repeal is a good idea?
Has anyone even considered what will happen when gay service men and women are not promoted? Or when a plum assignment they desire does not materialize? They'll blame it on ‘ homophobia ‘, there will be hearings, the press will champion more than a few cases and the careers of officers involved with such cases will be finished.
Officers with gays in their command will be sorely tempted not be rate them honestly for fear of retaliation. Same damned thing happened in the case of Major Hassan. Everyone knew the man was a true thread but what was being done about it? No one dared to stand up as they'd be branded anti-muslim and they'd have to kiss their career goodbye. It was pass the buck with Hassan and it sure as hell will be pass the buck with any half wit homosexual in the service.
I'm not even going to get into gay officers giving their boyfriends promotions, sexual harassment by gay officers of enlisted men and on and on it goes.
