What a bunch of garbage! An elderly Manhattan woman living on Social Security was slapped with a $100 ticket -- just for throwing away a newspaper in a city trash can. Delia Gluckin, 80, tossed the paper in a bin right outside her Inwood apartment building Saturday morning, only to be ambushed by an overzealous Department of Sanitation agent wielding a handheld computertized ticket book. "I was walking to take the subway downtown and dropped it in a trash can, and this lady in a blue uniform ran up to me," Gluckin told The Post.

She should have refused to give the woman her name, and not shown ID. I don’t believe a person walking down the street is required to carry ID or show it.

A free society cannot last without the common decency of it's members. And we've lost that. Too many people living to get away with stuff, to cheat on their taxes, to lie, to take handouts if they are given whether they need them or not, and to just be crappy to other people.

They have harsh laws that mandate all kinds of recycling be done.
Yet, while city public trash cans are ubiquitous, and the city does have public, sidewalk, paper-recycling bins, but those bins are rarely found.
The woman should counter-sue the city for not placing their own paper, public recycling bins on her block.
True, but the article doesn't say anything about her being ticketed because the item she threw away was recycleable. It implies that she was ticketed because she was throwing her household trash into the curbside bin (which she wasn't).
Are you saying you are in favor of ticketing someone if they throw away something in a curbside bin that is recycleable?

I did. A newspaper inside a plastic bag would not look like household trash to anyone with half a brain.
How can you tell the difference between a newspaper in a plastic bag or garbage inside a plastic bag? Do you have x-ray vision?

The dispute is over whether or not the “household” trash actually came from her household, or consisted of a few items she had acquired, and used while she was out that morning.
Citizens are not required to take home “trash” acquired while out of the home. In fact, the public trash cans exist so that they can properly dispose of exactly that kind of trash.
I don’t think it will take a high priced lawyer to win her case.
I am not sure if they kept the 'garbage'. It would be a she-said, she-said case.
I am so noit surprised. I guess it comes from low paying jobs that only less than stellar people will take and then we give them “authority” .

The city will not do this because every building is required to have a recycling area inside. On the appropriate day, the landlord takes the recyclables and places it curb side for pick up. Granny simply did not throw her stuff in the appropriate bin. Her newspaper should not have been together with regular household trash.

I lived on the upper east side of Manhattan from ‘79 through ‘01. One day I picked up my mail on the way out of my building and went through it in my car. Afterwards, I threw away some empty envelopes, etc. in the trash receptacle on the corner of 82nd and York. About one month later I got a 50 dollar ticket from the Sanitation Dept for using a public receptacle for personal trash. I paid the ticket but vowed to move out and I did. Tough place to live.
