What is unclear is the extent to which companies such as Walmart will be asked to assist in detaining persons of interest. The Gazette asked Walmart corporate if DHS was expecting them to detain individuals, if requested by law-enforcement, until officers could arrive at the scene. They were also asked if they had received assurances they would not be held liable if they detained someone based simply on a report by another customer. Multiple requests for information were not returned.
There has already been one such case in which a private company was sued for acting on individuals with concerns. In November, 2006, US Airways removed six Muslim imams from a flight in Minneapolis. Passengers reported the men after they became concerned about their behavior. Three of the men had prayed aloud in front of passengers as they waited for the flight to depart. Upon boarding, a passenger passed a note to the pilot expressing concerns. The men reportedly were spaced out throughout the cabin, speaking in Arabic and cursing US involvement in Iraq.
Based on the concerns, the Metropolitan Airports Commission and a Federal Air Marshall boarded the aircraft and detained the imams. Following questioning, they were permitted to board a later flight. The men subsequently sued the government and US Airways as well as the individual passengers who had reported their behavior. As a result of this incident, congress passed a law protecting individuals who report suspicious behavior, but no such protection was offered to business.

I'm not a lawyer, so I'm not sure how strong a case David Acton is making here, but it sure sounds like WalMart is setting its mangers up for a Section 1985 Conspiracy lawsuits, by running the Director of Homeland Security Janet Napoliatano clips in their stores.

I’m with you. I was changing planes in Dallas and we had to clear the terminal for some reason. We went back inside (through the metal detectors) and as usual, being the big Irish mug that stands out, I naturally get waved into the search room.
Three young Arabs walking by were pointing in and laughing ... I swear ... it was like “look how stupid these people are” and I looked at the TSA boob who was wanding me and said “you gotta be shitting me.” He shrugged. A minute later, he slipped out the door and rounded them all up - took them OFF the plane - and they patted them down. I was not going to get on that plane and I wasn’t going to let it go without raising hell and he knew it. We gotta stand up to this crap.

If Wal*Mart detained all the freaks in their store they’d need a holding pen the size of the store itself. I can see it now—the geriatric Greeter herds the incoming the left or the right, with one of the lines leading to the store and the other to the holding pen.

Don't know if I qualify as a cheerleader, but I do shop there. Mostly for groceries. And for one reason: Wally has the lowest prices in town. Until that changes, I'll continue to shop at Wally.
By no means am I criticizing your choice or reasoning. I am a big believer in going where the deals are. I just wanted to suggest looking for an ALDI in you area. I don’t know where you live, but if they have ALDI, it’s worth checking out. I now go to Walmart for ammo, and nothing else. And only then if I haven’t bought it at a gun show.

The “If You See Something, Say Something” campaign—originally implemented by New York City’s Metropolitan Transportation Authority and funded, in part, by $13 million from DHS’ Transit Security Grant Program—is a simple and effective program to engage the public and key frontline employees to identify and report indicators of terrorism, crime and other threats to the proper transportation and law enforcement authorities.
More than 230 Walmart stores nationwide launched the “If You See Something, Say Something” campaign today, with a total of 588 Walmart stores in 27 states joining in the coming weeks. A short video message will play at select checkout locations to remind shoppers to contact local law enforcement to report suspicious activity.
Over the past five months, DHS has worked with its federal, state, local and private sector partners, as well as the Department of Justice, to expand the “If You See Something, Say Something” campaign and Nationwide SAR Initiative to communities throughout the country—including the recent state-wide expansions of the “If You See Something, Say Something” campaign across Minnesota and New Jersey. Partners include the Mall of America, the American Hotel & Lodging Association, Amtrak, the Washington Metropolitan Area Transit Authority, sports and general aviation industries, and state and local fusion centers across the country.
In the coming months, the Department will continue to expand the “If You See Something, Say Something” campaign nationally with public education materials and outreach tools designed to help America’s businesses, communities and citizens remain vigilant and play an active role in keeping the country safe.

I live in Aiken County, SC. There is an Aldi in Aiken, the county seat. Also two Wally’s there. That’s where I shop. To be honest, I’ve never been to the Aldi. Mostly because folks I have talked with that have say Wally has better prices, better products and a better selection.
