When Thomas Baker was confronted by two youths while out on a late night run he decided to defend himself.
Having been punched in the face and fearing his attacker was armed he pulled out a handgun from his pocket and shot dead the teenager who had hit him.
As the gun debate rages afresh across America in the wake of the Tuscon massacre, prosecutors in Florida have ruled Baker should not face any charges, even though 18-year-old Carlos Musteller did not have a weapon.
Citing the state's 'stand your ground' law they ruled the 28-year-old was entitled to protect himself.
Under the 2005 law people have the right to use deadly force as long as they 'reasonably believe' their life is in danger.
The controversial ruling will fuel the raging nationwide debate over firearms in the wake of the Tucson shooting.
Baker was out jogging alone after midnight near his home in Tampa, Florida, when he was confronted by Mustelier and a 16-year-old youth. The teen told told police Mustelier decided he wanted to rob Baker, telling him: 'I'm going to bam him.. I'm gonna knock him out.'
Baker told investigators he was suddenly confronted by Mustelier who punched him in the face.

Well that will help the state budget somewhat. Every little bit helps.
I have a feeling the incident will go a long toward cleaning up crime in the area.
The most effective deterrent to thuggery is a story like this repeated in the media as frequently as needed.
And in other news, Tampa authorities are perplexed at a unexplained drop in crime locally....

Another way to give this article perspective:
Imagine you are a fairly small country with a fairly small army, but you have nuclear weapons. Now imagine another country with low WW I style technology is sending in a military force that is five times the number of people in your entire population.
What do you do? You nuke them, of course.
There is no “tit for tat” in self defense. You punch me, I punch you, etc.
IOW, if you are gonna attack someone, make sure you are better armed than they are.
I love a story with a happy ending.

Sounds like a good shoot to me. Anyone who thinks two punks can’t kill you with their bare hands is an idiot. First they knock you out (as threatened), and then you are at their mercy. Head stomps? Kicks? We’ve all seen the videos showing what these animals can do when they have you defenseles. (And no, I have no idea what race anyone was. Two punks threatening to “bam” and knock someone out while robbing them are animals. Period.)

Mr. Baker needs to carry a sharpened screwdriver, bought at a garage sale, with cash, and not matching anything in his garage.....and carry it with him if he carries a gun.
The fact that he only shot one of them shows he had a great deal of mercy and restraint.
That or the other guy go out of Dodge before he could draw a bead on him.
