Surely no one here can be surprised at this after this administration basically ignored judges rulings on oil drilling and Obamacare.

They need to be taken down a few pegs.

Absolutely. As I said on another thread, this time he has jumped the shark, IMHO. Impeachment proceedings should begin shortly if the Repubs can see beyond their noses.

Why is this impeachable?

Article III confers no power on the USSC which is superior to the Executive or the Congress.

“Obama” is of course wrong on the issue, but leaders have been MUCH too deferential to the Court in the past, and maybe that will change.

Holder doesn't know the difference between the Fifth and the Fourteenth Amendments.

The equal protection clause is in the Fourteenth Amendment, not the Fifth Amendment.

CNN has the text of Holder's letter here ...

Paragraph 1:

After careful consideration, including review of a recommendation from me, the President of the United States has made the determination that Section 3 of the Defense of Marriage Act (“DOMA”), 1 U.S.C. § 7, as applied to same-sex couples who are legally married under state law, violates the equal protection component of the Fifth Amendment. Pursuant to 28 U.S.C. § 530D, I am writing to advise you of the Executive Branch’s determination and to inform you of the steps the Department will take in two pending DOMA cases to implement that determination.

When the leader of the Executive branch unilaterally decides what laws are Constitutional while ignoring Judicial rulings on un-Constitutional laws, it is time to impeach.

I whole heartedly agree, but there are too many wimps, RINOs and Dimwits in Congress to do anything.
