Suspected Tucson gunman Jared Loughner has been indicted on 46 new charges, including the murders of a federal judge and an aide to congresswoman Gabrielle Giffords.
The new indictment, by a federal grand jury in Arizona, is the first step in a formal Department of Justice process to decide whether to seek the death penalty against the 22-year-old.

If they seek the death penalty. I don’t trust the Holder Justice Department.
Holder won’t let them execute him. Loughner is a DNC hero. He saved their assault on America.
Could face the death penalty? Huh? There were, what, a couple of hundred witnesses that saw him do it?
“Jared Loughner is indicted on 46 new charges in Tucson shooting - and could face death penalty”
The guy did it; a zillion witnesses, etc. We need Judge Parker (True Grit); he would straighten him out.
This guy tried to kill a DEMOCRAT congresswoman, of course they’ll seek the death penalty.
He should be put to death. Unlike liberals who would be cheering the death of any conservative poltician, I actually believe in the law and this maniac murdered and injured many. Kill him twice.
Insanity.
He’ll probably outlive most of us.
Three hots and a cot and boatload of mind-numbing drugs are in his future.
Just wait until Ed Asner and other Hollywood bleeding hearts get a load of that...they will be having rallies supporting Loughner. Placards supporting Loughner will show up at all political rallies as well.
I am sure they only say it to ensure that Jared, even though blatantly guilty, is given full due process. They say ‘if,’ I am sure, to maintain the proper procedure for the trial. They could say, ‘will,’ but that would presume he is guilty until proven innocent, which would be a violation of his constitutional rights.
but...but...I thought Sarah Palin did this?
This person should have already been tried, convicted and executed. Some crimes are so obvious that it’s a travesty of justice to let the killer live more than 30 days. What possible reason could there be for this person not to receive the death penalty and to have it carried out ASAP?
I am a firm believer in the death penalty. Not necessarily for its deterrent value but for its penalty value. If the certainly of capture, trial and application of the death part is enhanced in some cases by the addition of deterrence then IMHO it’s just serendipity.
I reiterate, he tried to kill a DEMOCRAT! Hollywood hates attacks on Democrats.
Obvious stupidity on the part of the prosecuting attorneys on this level and in such a public case is disheartening.
This is a case where insanity isn't just a defense ploy, but is an obvious factor that should have framed how the case was presented.
Going for the death penalty in this case makes the state prosecutors look like an ill convened aggregation of random bumblers (even if that is the case there is no need to make it obvious).
This case should have been handled quietly out of the public eye, and Loughner should be put in mental care someplace where he can be compassionately but irresistibly sequestered under mental care.
“conservative poltician”
Giffords WAS considered a conservative democrat by the left. Days before she was shot, she recieved death threats on DailyKos as a “traitor”
You’re right. You’re entirely correct, BUT, if he were rushed through, it would set an unpleasant precedent for others and eventually abused. Due process must be followed and maintained, no matter how odious and obviously guilty the suspect.
“Loughner should be put in mental care someplace where he can be compassionately but irresistibly sequestered under mental care.”
Where he could end up being released in the future. If he is so insane, so crazy, so tormented, that he goes on a rampage, in this respect, death would be an appropriate measure. Like the Manson women, there is always that possibility that he could end up being released and able to go on another shooting spree.
It shouldn’t even be a question for the prosecutor as to whether he will seek the death penalty or not. I understand the need to maintain the presumption of innocence, but that doesn’t stop the state or the Feds from charging him with multiple capital offenses. There is no doubt that he deserves it.
What was it, that Giffords failed to toe the line upon? They were all up in arms on KOS, DU, all the Dem and leftist sites.
Oh, that’s right. Pelosi. Didn’t support her for House Minority Leader, voted against her in fact.
All the shrill “off with her head” rhetoric on those hate sites compelled Loughner to act upon it in the real world.
