Terry report: Border agents fired first -- with bean bags

TUCSON (KGUN9-TV) - On the night he was killed, there is no indication that Border Agent Brian Terry ever got off a shot. That is one of the revelations contained in a confidential document that 9 On Your Side has obtained.

The document is a BORTAC incident report - BORTAC being an acronym for Border Patrol Tactical Unit. According to the report, Terry was one of six officers taking part in a patrol in the Rio Rico area - not four, as the Border Patrol had previously stated. The Border Patrol has said very little about what happened that night, but after the shooting stated that four officers had been looking for bandits preying on drug and human smugglers.

The incident report states that shortly at 11:15 PM on the night of December 14, a group of five people approached the officers in the Peck Well area, where the officers were waiting in the dark. The agents saw that two of the men were armed with rifles. One agent identified himself as a Border Patrol agent - then, according to the report, fired two rounds from the non-lethal weapon he was carrying, a shotgun that fired bean bags. That agent, the report says, then continued the firefight with real bullets, fired from his service firearm. A second agent joined the firefight, using his service M-4 rifle.

The incident report does not specifically say, at this point, that the suspects returned fire. But after the shooting stopped, Terry cried out that he was hit and that he could not feel his legs. He lost consciousness moments later.

Later agents arrested four suspects - one of them was severely wounded. If any of the agents saw what the wounded suspect was doing when he was hit, it is not indicated in the report.

Out of an initial six suspects whose arrests were announced following the shooting, only one remains in custody - the one who was wounded on the night of the attack. Even that suspect has not been charged with murder as of yet.

This incident report was first leaked a few weeks ago and has appeared on various blogs. A reliable source told KGUN9 News that it is authentic.

Why are Border Patrol agents in Arizona ordered to fight with bean bags against AK-47s?

This is definitely Obama’s fault, and McCain is complicit.

This is reminiscent of that scene in Sherlock Holmes, where Sherlock hit the Frenchman in the chest with the hammer and it bounces harmlessly off.

Questions that should be asked:

Who approved ATF's Operation Fast and Furious?

What disciplinary action has been taken?

Has anyone even been reprimanded?

Was Border Agent Brian Terry murdered with a weapon that ATF allowed to fall into the hands of his killers?

We need answers.

I'm not sure what their use of force policy says, but I bet it doesn't say use non-lethals when presented with a deadly force threat.

Opening fire against known armed individuals with a non-lethal is a sure fire way to receive fire in return.

Man, isn't that true!

I'm sure Terry's team has been interviewed regarding the incident, and I'm sure that this issue was covered.

Do you think the public will ever be able to read the report?

If not, do you think any of his team members will go public?

I hope so.

Just a thought but if I were a Border Patrol Officer......I wouldn’t give a good GD what the higher ups said, if I saw an AK-47 there is abosolutely no way I would fire bean bags first.
Better to be fired for going against regs than dead.

Amazing that the BATF & other agencies can use live ordinance on it’s own citizens..yet cannot be armed to protect themselves against opposing foreign people.
Am I missing something here?

Protecting drug smugglers and human smugglers from preying banditos. Is this new to the BP job description?

Bean bags are for playing Cornhole. Officer Terry’s supervisors needs to play a little Cornhole in prison.

Except getting fired is just a first step. Next is trial, then prison.

Questions that should be asked:

Was Agent Terry killed by an ATF operative who subsequently left weapons behind as planted evidence?
