LAPD limits impounding of unlicensed drivers' cars

Under criticism that it was unfairly targeting undocumented immigrants, the Los Angeles Police Department on Friday announced changes to its rules for impounding cars of unlicensed drivers at sobriety checkpoints.

Previously, LAPD officers at such checkpoints followed stringent protocols that called for them to impound a car whenever the driver was found not to have a valid license, regardless of whether the driver had been drinking.

Those rules have drawn the ire of immigration advocacy groups that said they disproportionately targeted undocumented immigrants, who are not able to obtain licenses legally in nearly all U.S. states. Once a vehicle is impounded, law enforcement agencies often require it to remain locked up for at least a month and charge the owner hefty fees to release it.

The new LAPD guidelines soften the department's stance somewhat. Police will be required to make an attempt to contact the registered owner of the stopped vehicle. If the owner is a licensed driver and can respond to the checkpoint in "a reasonable period of time," the officers will release the car to him or her. If the owner is unlicensed, officers will permit another person who is a licensed driver to take the car.

If no one with a license is available, police will impound a vehicle. In any case, police will issue a citation to the unlicensed driver.

So the LAPD stops a car driver has no license, no insurance on car, police there have enough time to sit around and wait to see if anybody with a license can show up to drive the car away and still do not require the new driver show proof of insurance. Anybody else will be arrested for driving without a license and for not having proof of insurance.Funny how these immigration advocacy groups have no problems diverting police from away from their other duties.

If the owner is unlicensed, officers will permit another person who is a licensed driver to take the car.

Car laundering, the next great California industry.

Most agencies in TN do that same thing, they let the driver call someone to come get the car or the owner can pay a wrecker to carry it home for them.

Impounding is a last resort.

Do you mean that if I don't have a valid license or insurance that I'm not allowed to drive and may have my car impounded? What is this country coming to? I thought that the rule of law has already been suspended.

If it hasn't, give the Kenyan a couple more years...he's working on it.

...and the citation will be useless because the address provided by the unlicensed driver will be phony, and he’ll never appear in court.

Looks to me like this applies only to Sobriety check points the police do at times. It doesn't mention routine stops for other infractions ....

It's unfair that they can't drive illegally......they entered illegally..........they work illegally......why can't they drive illegally?

In the interest of fairness, licensed drivers should have their cars impounded, because they can afford it.

Punish the innocent, reward the guilty.

Anything else is racist.

Good news for gun runners, drug smugglers and drivers in stolen cars too, right?

Since “sobriety” is all they’re allowed to enforce, then all must be allowed to walk (or drive) on non-related offenses.

It goes something like this. Most Illegals are not only driving without a License, and insurance. They are usually driving some dilapidated $100 POS that isn’t worth the space it’ll take up at the impound yard. The “owner” will never come to claim it and it’ll sit for months while the authorities process the paperwork to try and sell it at auction to reclaim their costs.

Rest assured whitey will still receive the the full effect’ of the law.

The last thing an Officer wants [read: Lawsuit ] is an unlicensed driver to get in an accident with an Officer's 5-minute old ticket sticking out of the unlicensed driver's pocket.

Yeah. How DARE those police officers unfairly target those poor put upon LAWBREAKERS.

I think we ought to get the FBI to lighten up when it comes to bank robbers too.
