DOJ letter:'TSA would likely be required to cancel any flight'(FEDs threaten air blockade of Texas)
The Lone Star Report ^ | 5/24/2011 | Andy Hogue

The U.S. Department of Justice sent a letter to House and Texas Senate leaders Tuesday -- reportedly in person -- threatening a shut-down of airports if HB 1937 is passed.

The letter claims Rep. David Simpson's (R-Longview) anti-TSA-groping bill is against federal law and the Supremacy Clause of the U.S. Constitution. We include the text of the DOJ's letter, as well as a portion of Simpson's reply, below.

Wow. When I called Dan Patrick’s office I got right through. I guess everyone else that could have called was busy storming the capital.

If you bothered to read the article, it is the Senate that is killing the bill. Your friends in the House can pass anything they want anytime they want and it’s not worth the paper it’s written on.

Below find message sent to Sen. Patrick, Rep. Simpson, and Lt. Gov. Dewhurst:

Dear Sen. Patrick,

I understand from press reports that Federal agents have threatened to impose a “No Fly Zone” over Texas, as has been done in the past and present to rogue states such as Iraq, Libya and Bosnia, and this threat is in response to the exercise of the duly constituted legislative powers of the Texas Legislature.

I am of the opinion that this federal threat is contrary to the U.S. Constitution, as per Article 1, section 9 quoted below.

Article. I. - The Legislative Branch
Section 9 - Limits on Congress
No Preference shall be given by any Regulation of Commerce or Revenue to the Ports of
one State over those of another: nor shall Vessels bound to, or from, one State, be obliged
to enter, clear, or pay Duties in another.

I am further of the opinion that the regulations or policies imposed by the Secretary of Homeland Security regarding unwarranted searches and seizures of persons boarding aircraft are contrary to the 4th Amendment of the U.S. Constitution.

Accordingly I strongly support your efforts for passage of HB 1937 in defiance of federal threats of a No Fly Zone and air blockade. I further suggest that should the federal authorities make good on their threat, the Texas Railroad Commission should, in the name of safety and security, shut down all interstate pipelines carrying natural gas and refined petroleum products out of Texas.

You have my full support.

Best regards,
aka “ThirdMate”

I had cobbled this together as soon as I heard. It also refers to the transportation aspects of the edict...

I have just heard about HB 1937 being withdrawn.

I must strongly object. The correct strategy would be to reinstate, then pass the bill and force the heavy hand in Washington to make the choice to block American Citizens in Texas and traveling to Texas from free movement.

Under such circumstance the airlines will also be required make a decision on do they continue remaining silent or voice an opinion on the ongoing and unchecked offenses of the TSA.

Cities, county and regional airport operators will be adversely affected by yet another hindrance of their freedom to operate in open commerce.

Simply withdrawing HB 1937 is NOT in the interests of Texas or its citizens as the threat by U.S. DOJ on this matter is but one in a series of direct attacks against The State of Texas by an offensive and unrestrained federal government.

And emailed it to every address I could find. We will see if it gets any play. I was told pretty much the same thing on each call I made, they are working on a re-write and resubmission but the time is very short.

.

"I am of the opinion that the more people fly, the better this will get, if before your flight, you make a concerted effort to load up on some potent Tex-Mex so that when the time comes, and the groping begins, you have an subtle answer to that groping that if applied liberally might fend off continued gropage..."

"Just an idea..."

Careful or you could end up being charged with using a weapon of *ss destruction.... Just sayin. That Tex-Mex can be lethal

Kinda wish we could do something to hurry that along...

Maybe a weekly local media “rogues gallery” of TSA agents at our local airports...

Do kinda like a background story, where ya from, where did you go to school, graduate??? What are your goals in life...

You know, the little personal interest stories...

“Groper of the Week” award...

Right???
