In a final act of revenge, Elizabeth Edwards secretly recorded a testimony in her dying days that helped prosecutors indict husband John last week, it was claimed today.
John Edwards is due to stand trial on charges that could lead to a 30-year jail sentence after he pleaded not guilty on Friday to using $925,000 in campaign funds to cover up an affair and love child.
The estranged wife of the former presidential candidate is alleged to have filmed a damning testimony that was central to the prosecution’s case for charges.
Friends said the cancer victim, who died in December, wanted to ‘haunt’ her estranged husband and his mistress Rielle Hunter, with whom he fathered a child and made a sex tape
Bruce Baron, an expert on federal law, said: ‘The value of a potential dying declaration, or tape, containing the testimony of Elizabeth Edwards, is devastating to any case or defence that Edwards would have.
‘On the secret video, Elizabeth spells out everything she knew about John’s affair with Rielle and how he managed to cover it up for so long,’ a source told the Enquirer.
‘She also spills all of John’s lies – many of which could be what sends him up the river.’
‘Elizabeth wanted to haunt John and Rielle – literally from her grave – and she has,’ the source told the Enquirer.
‘She hated them with a vengeance. This was a woman who took her final breath in the same bed where John once had sex with his mistress.’

BobL, seems every time you pop up I don’t even have to post. I have every sympathy for their loss, in their young son’s death. I wouldn’t be the same either. But though I know women are harder on women than any man and I am the worst at being up to here with the voice of women. Especially, in life, Elizabeth Edwards, a full throated political hustler herself hawking her husband full boar and plenty narcissistic herself.
This is a woman who tried to dupe us all into thinking the man would make a suitable president by parading herself around as a courageous potential first lady in the face of her disease. What a horrible testament to one’s life by getting revenge revenge on her slimeball counterpart as she gasps for her last breath. UGH! May justice be served to them both!
John Edwards would have been better off pleading guilty for a reduce charge to avoid a public trial. Prime example of her being a smarter attorney than him.

This statement is a good one and the consequences in Edwards' case may be jail time. Tough lessons for the kids to learn but it may make them think before they do something like follow in their dad's footsteps. This is not just a little indiscretion.

You are a bit confused.
1. Testimonial privilege. A person cannot be forced to testify against a spouse because the law resepcts the absolute commitment that married people ideally should have to one another. In federal court, the person who would testify is the one who can claim the privilege. In other words, if a person wants to testify against his spouse, he can. But he cannot be compelled to do so.
2. Marital confidence privilege. A person has a right to expect that information he shares with his spouse in confidence will not be used against him. This is similar to attorney-client privilege. Nothing said in the presence of a 3rd party is privileged, and the parties have to intend the information to be confidential. However, anything said to advance a criminal conspiracy is not privileged.

I had forgotten about the kid. But the wife was in it for power just as much as the hubby - if their marriage was blessed, he wouldn’t have jumped on the (much less good-looking) Hunter babe. They both knew it was a total charade.
