Appeals Court in Ohio Upholds Health Law (Requirement to buy Health Insurance is Constitutional)

A federal appeals court in Cincinnati on Wednesday upheld the health-care law passed by Congress last year, saying the law's requirement for most Americans to carry insurance or pay a penalty is constitutional.

The vote was 2-1 on the three-judge panel on the key question of whether the insurance requirement exceeded Congress's powers under the Commerce Clause of the U.S. Constitution. The majority concluded that it did not.

The law is only what the court says it is.

For all those thinking of sitting out the next election or going third party because your “pure” candidate didn’t win the primary - remember that when Obama makes a couple more Supreme Court picks.

The difficulty in opposing such a law with civil disobedience is that it is something most people will do anyway, and the providers will comply.

President Bush has been given awards by conservative judicial watch groups for his stellar judicial choices.

(btw, do you write for the NYTimes by any chance? I believe that they say he was the 'worst President ever' too. Are you sure that President Bush is the one who's a 'piece of crap?').

Without the mandate the whole thing wont work. Because everyone would just wait till they got sick or hurt to get insurance then.

Well, 10 of the 15 6th Circuit judges were appointed by Reagan, GHW Bush or GW Bush (8 of them by the latter), so even if the pending Obama nominee is confirmed before the en banc hearing, there would be 10 GOP-appointed judges to 6 Democrat-appointed judges. Of course, one of the GW Bush-appointed judges already ruled that the individual mandate does not violate Congress’s powers under the Commerce Clause, so we pretty much start off 9-6 (or 9-7 if the Obama nominee gets confirmed soon) advantage. I find it absurd that a judge would rule that Congress can force Americans to purchse a product from a third party (as opposed to merely making it a condition in order to attain some privilege), but obviously there are a lot of stupid judges out there, so I’m not comfortable making any predictions.

Of course if only a few hundred or thousand people do this, probably all you will end up with is an audit. But if even a couple million did this it would certainly send a message.

I have a better idea. Come April 15th, a few million of us simply refuse to file and send the bastards any more of OUR money.

CUT THEM OFF AT THE KNEES, JUST LIKE THEY HAVE DONE TO US!

THERE IS NOTHING THEY CANNOT TELL YOU TO PURCHASE.

That part is coming, my FRiend,soon after obamacare is fully implemented,you will be notified to report to a physician's office.Once you are there, they will take your blood pressure, body weight/mass and refer their results to a chart that is calibrated according to height. A few dys later, you will receiv a notice in the mail as to what foods and in what quantity you are authorized to purchase. Unauthorized purchases will not be allowed.
