Rep. Hoyer endorses 14th Amendment option as a last-resort solution

President Obama should invoke the 14th Amendment to hike the debt ceiling unilaterally as a last resort to prevent a government default, House Minority Whip Steny Hoyer (D-Md.) said Thursday.

"It's arguably his power to do so," Hoyer told MSNBC.

"Very frankly, if it came down to his looking default in the eye on Tuesday or taking this action, as President Clinton said, better to take the action and find out later that perhaps he went beyond his authority but at least protected the credibility of the United States of America," he said.

The remarks align Hoyer with a number of other House Democratic leaders, who are urging Obama to invoke the Constitution to prevent a government default if Congress fails to raise the debt limit before an Aug. 2 deadline.

Some guy from Roll Call was on Greta tonight saying the polls are all over the place. The parties are held in low esteem, Obama is in trouble, and seem to indicate Republicans would get the blame, but when you broke down what the Republicans want, like balanced budget, holding spending, etc., the poll was like 76% in favor of our agenda. We may not take such as a hit as the panicking media hopes for and tries to frame.

If we're playing Democrat, why not try this logic? Not extending the debt ceiling would make us slaves to the debt cap and the current budget. The 13th Amendment prohibits slavery, so the cap is unconstitutional. Well, that's just as valid as the 14th Amendment argument.

It's always interesting how liberals think. It's never "what is the law?"; it's always "what can I get away with?"

Yes they are defaming that noble document. They are taking that sacred piece of parchment and wiping the evil foul butts with it.

The following from Article 14 on which they base the opinion that they can increase the debt limit via presidential edict: The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.

Only congress can issue debt per the constitution as all spending bills are a function of the Legislature. The spending bills must be reconciled via the budget. If Congress does not budget the money, it can not be spent. The only legal obligation we must pay if for past borrowing. Any future borrowing has to be via permission of the Legislative branch.

Obama is trying to assume the power of the Executive and Legislative and Judicial, hell he already has the Judiciary via Eric Holder.

If he does this and gets away with it, we have the beginning of a new dictator ship.

That’s highly unlikely because raising the debt limit through an executive order would not go over well with most of the public and that would do a lot of political damage to the democrats.
