FORT HOOD - Lieutenant General Donald Campbell Jr., the Commander of Fort Hood said Wednesday accused gunman Major Nidal Hasan still has his rank and is still drawing a paycheck from the military while he awaits court martial set for March 5, 2012.

Hasan's confinement and medical expenses are also being paid by the military, and he is moved on post once or twice a week for treatment and occasionally to see his legal defense team.

Sometimes that whole “innocent until proven guilty” thing is inconvenient...

Note that the article omits to mention how much he earns.

Since he has NO need for the money, I wonder if he donating it all to a mosque somewheres..

it presumes guilt before an adjudication

Not really; think of it as holding his pay in an escrow account.

Here's another way to look at it. Suppose I worked for you and you have accused me of theft. And so I've been arrested and imprisoned.

Do you have an obligation to continue paying me while I'm in prison and awaiting trial? I think not.

The obligation you do have is to make things right if I'm found not guilty.

Adherence to the law is not discretionary.

Not unexpected. Until he goes to trial or courts martial, he still receives his pay. He cannot be punished before the trial.

Actually, it’s normal. Until the soldier is convicted, he is only accused and is still entitled to rank and pay. When convicted, they are stripped of rank (E-1) and lose pay.

What I am proposing is not illegal or unusual at all. In fact, it's quite common in tenant-landlord disputes.

Suppose you rent an apartment that you later claim is unfit for habitation. So you refuse to pay the rent.

Very often a judge will order that the rent continue to be paid, but be put in escrow.

If the final ruling (the “trial”) favors the landlord, he gets the escrowed rent. Otherwise, it's returned to you.

It's a very fair and sensible system. I can't see why it cannot be applied here.

And we can’t cut one dollar from the budget,,....NOT ONE! I’m sure a 1 hour lookie see would get a few more of these, “low hanging fruit”. How about checking all computers for child porn and an hour or more of Solitaire and fire those? How about anyone heard quoting Mao in the last year? That right there would get about half of the government.

Because the law does not allow this discretionary authority regardless how sensible your suggestion is.

I'm a bit tired of all these hyperbolic stories about crap like this. Innocent until proven guilty, due process, law. Who the hell wants to live in a country where you can simply be accused of a crime and lose everything?

The guy is most likely guilty, but he is due his day in court. When he is convicted he will lose everything and justice will be served. In the meantime, I'd like to continue living in a free country.

WHY THE HELL DID WE LET A LOONIE MUSLIM INTO OUR ARMED FORCES!?

Ask the Pentagon? They were actively recruiting Muslims under Bush, and lowering the bar for them, and I imagine it's gotten even worse under the Commie Muslim in the White House today.

Google Gordon England and Hesham Islam for a typical example of what's been going on in our politically correct military. Not to mention the terrorist radicals that Barry has been installing at the highest levels of our military and security.

Typical Federale Government waste. A fine example why we are in a Gov’t debt crisis. Just throwing money out the door because it’s not your money....so what does a Federale drone care as long as he keeps getting his paycheck?

The question isn't why he has rank and pay, but WHY THE HELL DID WE LET A LOONIE MUSLIM INTO OUR ARMED FORCES!?

If it had stopped with him, we could have said, well, we learned our lesson the hard way, let's not let any more of the murdering bastards in but we are still taking them into our military.

OK. What about this idea........

Military man with family is accused of a heinous crime he is innocent of, docked of all pay and benefits - his family starves, his house is foreclosed on, his car is repossessed, and such will continue until he ‘speeds up the process’ and admits to whatever they want him to admit to.

Do you see a problem with that?

The an is a paraplegic the last I heard, Crippled from the waist down.

IF he is found guilty he will be stripped of his rank and pay, but in some form or other we will be paying for this crippled murdering CS for the rest of his life.

It will cost us a ton of money for physical therapists and a special cell and special attention to keep this Muslim POPS alive, and thinking about capitol Punishment with OPbama in the White House is a joke.,

face it this guyis guranteed to live a long life with servants ( nurse’s, physical therapists, doctors) around to wait on him for years.

You've got a point there. but that's true even if the accused is not a military man. Suppose a civilian is picked up for a crime and sits in jail for six months waiting for his trial.

Who takes care of his family in that case? Should the government - who put him there in the first place - pay his bills until trial? Or should his employer be forced to continue to pay him every two weeks?

A citizen taxpayer should have no fewer rights than someone who works for the government.

OK, so what's wrong with this idea: all pay stops when the accused is indicted. If he is later found innocent, he gets all back pay plus interest.

Outside of the fact it goes against the dictum “innocent until proven guilty”, nothing at all.

Why don't we just get rid off all these lengthy, boring trials and go with, “hey, if the prosecution say someone’s guilty, that's good enough for us and we just punish every defendant on government sayso. The government wouldn't indict these people for crimes unless they were guilty, would they?”
