Fired former Yahoo CEO Carol Bartz could lose $10 million for violating a non-disparagement clause when she raged that the company's board members 'f***ed me over.'
Miss Bartz, in an interview with Fortune after her Tuesday firing by phone, also said the board was 'trying to show that they're not the doofuses that they are.' However, according to Fortune, her contract with Yahoo contained a clause barring her from criticizing the internet company.
A source told the magazine that Bartz could lose $10 million over her pointed comments.
That clause, if violated, could allow Yahoo to cancel a $10 million payout, due if she was sacked.
Miss Bartz made the call to the influential business magazine from Silicon Valley as reporters waited outside to report the news of her departure.
She said she was in New York on Tuesday to speak at Citigroup's technology conference on the following day. And she revealed that she was scheduled to call Mr Bostock at 6pm but when she did he promptly started to read a lawyer's prepared statement dismissing her. Miss Bartz told Fortune: 'I said "Roy, I think that's a script. Why don't you have the balls to tell me yourself?"'
She went on to explain that the by the end of the call she merely replied: 'I got it. I got it' as he finished reading the dismissal notice.
She told the magazine she had told her former boss: 'I thought you were classier.'

Her post firing behavior is certainly consistent with that. If she wants to collect $10 million severance after getting fired, its not too much to expect that she keep her mouth shut.
Defending her choice of words describing what they did to her may be the easiest part of the inevitable lawsuit.
Establishing the factual basis for informing Fortune magazine that the Directors are “doofuses” could also be a walk in the park.
EternalVigilance offers the key, her challenge will be to demonstrate how each of the board members had a hand however so slight in developing Yahoo’s new email program, or paying for it, or approving its release, all over her vigorous and timely objections. I have been a user since my floppy disk days and the current program sucks. Experts and milions of users will rise to her defense if she can link the Board.
They can also use HighWheeler’s photos to depict the stress she has endured and the obvious physical hardship she has experienced trying to save the company from the actions of this totally inept Board. Hell, with a little luck she may get more than $10m.

Same here; and I am NOT "upgrading" to let them read my INCOMING mail to target ads to the SENDER! I will miss my Yahoo account, but I'm dropping my membership.
They have slowly but surely removed one favorite feature/workability after another, and now their new email policy & program is the last straw. I'm slowly downloading the emails I've saved over the years; and the addresses I have there & not elsewhere (very few), then pulling the plug.
