Fired former Yahoo CEO Carol Bartz could lose $10 million for violating a non-disparagement clause when she raged that the company's board members 'f***ed me over.'
Miss Bartz, in an interview with Fortune after her Tuesday firing by phone, also said the board was 'trying to show that they're not the doofuses that they are.' However, according to Fortune, her contract with Yahoo contained a clause barring her from criticizing the internet company.
A source told the magazine that Bartz could lose $10 million over her pointed comments.
That clause, if violated, could allow Yahoo to cancel a $10 million payout, due if she was sacked.
Miss Bartz made the call to the influential business magazine from Silicon Valley as reporters waited outside to report the news of her departure.
She said she was in New York on Tuesday to speak at Citigroup's technology conference on the following day. And she revealed that she was scheduled to call Mr Bostock at 6pm but when she did he promptly started to read a lawyer's prepared statement dismissing her. Miss Bartz told Fortune: 'I said "Roy, I think that's a script. Why don't you have the balls to tell me yourself?"'
She went on to explain that the by the end of the call she merely replied: 'I got it. I got it' as he finished reading the dismissal notice.
She told the magazine she had told her former boss: 'I thought you were classier.'

If I lost a $10 million dollar seperation package because of some BS non-disparagement clause, every executive who had a role in dismissing me better be looking over their shoulders for the rest of their short-assed lives.

No sympathy here. It was a "BS non-disparagement clause" to which she agreed in a contract. If the company chooses to exercise that clause, she brought it on herself with her own stupidity.
Maybe they could hire somebody who could make them a stable, reliable, usable email system.

Personally, I think firing someone by phone is poor. Have the decency to do it in person.
If you signed a non-disparagement clause and then violated it you are the one in the wrong. I hope they keep the 10 mil and anything else they can.
