Justice Dept. proposes lying, hiding existence of records under new FOIA rule
The Daily Caller ^ | 10/24/11 | C.J. Ciaramella

Posted on 10/24/2011 9:35:46 PM PDT by Nachum

A proposed revision to Freedom of Information Act rules would allow federal agencies to lie to citizens and reporters seeking certain records, telling them the records don’t exist.

The Justice Department has proposed the change as part of a large revision of FOIA rules for federal agencies. Specifically, the rule would direct government agencies who are denying a request under an established FOIA exemption to “respond to the request as if the excluded records did not exist,” rather than citing the relevant exemption.

The proposed rule has alarmed government transparency advocates across the political spectrum, who’ve called it “Orwellian” and say it will “twist” public access to government.

In a public comment regarding the rule change, the ACLU, along with Citizens for Responsibility and Ethics in Washington (CREW) and OpenTheGovernment.org, said the move “will dramatically undermine government integrity by allowing a law designed to provide public access to government information to be twisted to permit federal law enforcement agencies to actively lie to the American people.”

No doubt the tests of this methodology in Hawaii have encouraged the commie oligarchs to institute it at the federal level. And what did they find out? ... Just that a lying clerk can cancel the law, so Eric the red Holder wants this to be institutionalized for demcorat criminal enterprise use.

Why go to the bother of revising the Act. All they need to do is give Sandy Berger access to the stuff they want to disappear, and their problems are solved.

From the excerpt:

A proposed revision to Freedom of Information Act rules would allow federal agencies to lie to citizens and reporters seeking certain records, telling them the records don’t exist.

The Justice Department has proposed the change as part of a large revision of FOIA rules for federal agencies. Specifically, the rule would direct government agencies who are denying a request under an established FOIA exemption to “respond to the request as if the excluded records did not exist,” rather than citing the relevant exemption.

[snip]

Upon taking office, President Obama released a memorandum declaring his administration was “committed to operating with an unprecedented level of openness. Specifically, he pledged to bolster the strength of the FOIA act, calling it “the most prominent expression of a profound national commitment to ensuring an open government.”
~~~~~~~~~
More incremental steps to a totalitarian government:
In this case, first legalize Federal government lying and then, what next,--- expand the list of FOIA exemptions?
The proposed revision has the added benefit of burying all evidence of the Fed's former and current illegal and unconstitutional actions.
What else is lurking is this "large revision of FOIA rules for federal agencies"?
Butter,
Not sure if you’ve seen this article and a ping to MHGinTN’s comment.
PROPOSES? It's been standard operating procedure since day one of ZERO.
Yes, but now they want legal cover so if some pain in the neck like, oh say, Darrell Issa shows up with the documents they can say "We didn't lie ... we followed FOIA guidelines!"
Disgusting!
ACtually, they’ve been operating as if this was the law for a long time already. Makes me wonder why they all of a sudden think they need permission to do what they’ve been doing all along.
If it’s somebody associated with Obama, and their lips are moving, I’d almost bet the family farm that they’re lying. That’s been documented time and time and time again.
Border fence? They gave us a VIRTUAL border fence.
FOIA request? Ah, yeah those records don’t exist...
BATF? Now distributes assault weapons 2 drug dealers
FBI? Covers up murders of federal agents
And POTUS has used multiple SSN’s —we don’t really even know if he IS the President
If 5 years ago I would have been told of these things I would not have believed it—I’d have said it was a LIE.
Here’s more to make you feel hopeless - not only are we aiding the enemy but, this admin is sidestepping the law and Congress at every point they can and writing the laws to suit themselves. IOW, we haven’t woken up to realize we’re in the middle of a coup.
